The Attorney who filed this suit used his daughter (2nd grade) as the excuse to file this suit. His original plan was to sue to have "In God We Trust" removed from our currency. However, after filing suit, he was kept waiting for an unusual amount of time before the Court responded, and he realized an easier suit to win would be to use his daughter and the fact that she was (not required) but subjected to actually having to hear or say "Under God". He claims it to be unconstitutional under the defination last defined by our legislators when the original athiest sued many years ago. And he means to continue the fight.

IMO, there's something wrong with Federal Judges getting lifetime appointments.

In the heat of the moment I tend to agree with you; however, if you think about it having lifetime appointments isn't as bad as having them elected every so many years. When that happens the laws really do mean absolutely nothing, because then the judges will do whatever the sheeple at the time want. If it's tax the top 20% and give 1/2 of their money directly to the bottom 20% then it will be done. Judeges have so much power they can create completely new laws in one ruling. Whereas, the President needs to have congress first pass the law. This tends to keep the country on a slower course to the left. If judges were elected the leftist ones would continue to legislate from the bench, but the right wing judges would do their jobs appropriately and pass judgements based on existing laws. It doesn't take long to see who will win that race.

But a better system would probably be appointments for 10 years. This way if they do some crazy sh!t we don't have to impeach them...we just don't have to renominate them.

Sorry. I only saw your first post and wasn't reacting to you, but the concept of an "outraged" Senate, many of whom are gleeful that the destruction has gone this far. I'll read further or be more explicit, next time.

Anyhoo, guess what I just learned on another thread?

Fox News analyst Newt Gingrich said tonight said that the man who wrote the opinion, "senior" Judge Alfred T. Goodwin, had to be "brought back from retirement to fill a vacancy," all because of Senate obstructionsim.

So I guess the fact that he was a Nixon appointee doesn't really matter. It appears he was there because of Dasshole. See we all learn on FR.

Is school still on this late in June in Ca? In any event, just wait until she has to find another school because daddy wanted fifteen minutes of fame to prove to us that he is a real you know what. If a child is that sensitive, she's got a lot to learn about life and being raised an atheist, it does not look good for her. Sounds like her dad's a whiner and she's just following his lead.

Now they'll discover school choice and nobody will want her. Thanks, dumb dad.

How about a little ageism? If a Judge is over seventy years old just like with driver's licenses, that Judge should be willing to take some continuing legal education courses and if he/she can't pass those courses, they're outta there. Someone eighty years old shouldn't be able to shut down the Pledge of Allegiance for the entire Western U.S. That's way more power than was intended to be granted to a district court.

I heard Harry Reid of Nevada say his two kids clerked for the ninth circuit. So, we know they're all messed up too.

Thank you for your very informative post.
It is so hard to believe that we have come so far from the courts opinions of our history.
The liberal judges and legislatures have destroyed the clear meaning of our constitution and it appears we can do nothing to stop them.
I don't know why they have the ability to shock me anymore, I should have known, but I didn't expect anything like this.
What a horror this day has been. Our country has been raped and the rapists are running free to do more damage.
God have mercy on this nation.

That's okay. I've been flamed so many times tonight that I lost count. The whole gang's here - disruptors, superior minds and regular folk like myself. LOL This little girl reminds me of Elian Gonzalez. Her life's been hijacked by her dad. Her objections sound like a ruse to me. Kids aren't that anti-anything at the age of seven. They are pretty open minded. Dad was on Fox. He wants God to just leave. It's not going to happen.

Bob, I was at home today, watching this unfold on Fox. Linda Vester was totally stunned. At least on Fox, they don't expect their anchors to remain emotionless when something really horrid happens.

When I called the Capitol, it seems the fla dem senator is the easiest one to get by phone so I talked to Sen. Nelson's office. (he's the one who went up in the space shuttle).

His staffer directed me to c-span but he'd already finished speaking. We have pubbie congressman in DC but our Senators (I think) are all dems. The staffer said that Nelson felt exactly the way I did. I kind of said part of the Pledge to the staffer; including "indivisible".

The bottom line is that when I want to COMPLAIN, I am very bi-partisan. But, besides complaining and signing Petitions re: the Pledge how can we push those Dubya Judges through the Senate? WORK TO GET THE VOTE OUT FOR PUBBIES IN THE SENATE AND THE HOUSE?

Someone is passing a personal greeting from me to Governor Jeb tomorrow at an educational conference. Jeb knows what good Americans we are trying to be here at FR. I don't think that Jeb would ever stand for the Pledge being denied Florida's students. Regards.

Ping. See prior post. The 80 year old Nixon appointee had retired but was returned to the bench due to vacancies caused by Tom Daschle holding up Dubya's nominees. This may be of interest to South Dakotans.
