The judge was indeed, appointed by Nixon. I don't know if the judge is a Republican or someone that Nixon appointed at the request of California democrats. The second judge was appointed by Carter.

The DISSENTER, the Hispanic judge, was appointed by President Bush (41).

Since you are obviously a DemocRAT, put up the real story. The judge that wrote the opinion was appointed by Nixon who never was a conservative, the judge appointed by Bush #1 dissented, and the Carter appointee went along with the Nixon judge! We don't know the political ideology of the Nixon appointee BTW because sometimes President's appoint members of the opposition to the bench.
