WESTERFIELD TRIAL: Week Three - Day Four

Here's the new thread, all ready for Thursday.

Testimony recently discussed includes fingerprint evidence, as well as Westerfield's clean laundry. The Van Dam home was (strangely) devoid of fingerprints, except for a couple of latents that didn't match any of the pizza party people or, apparently, David Westerfield.

Westerfield's motorhome didn't contain any of his fingerprints, but did have one print from Danielle L. (the daughter of Westerfield's ex-girlfriend), Jennifer (a friend of Danielle L.), and a partial from Danielle Van Dam.

The prosecution said yesterday that they would be finished "in seven court days".

Here are my Miss Cleo predictions so far; subject to change before you complete the reading:

Danielle was in the MH, possibly playing hide and seek...Danielle L and Jennifers prints will be from outside the window (tech did not specify for examiner).

Witnesses will testify the MH had been parked down at the park on occassion and kids seen in/around.

Blood on curtain was from a cut or bleeding scratch on her left arm while "driving" the MH, the jacket was hanging on the drivers seat at the time, which she brushed against right shoulder when getting into seat, neck area when she pushed up to look out window to see if anyone was looking, getting a 2-3mm smear of blood on curtain.

The blood stain on the comforter was made when she was in bedroom of MH peeking in cabinet for a band-aid.

BVD and DW have had a relationship for 6-8 months, not necessarily sexual but did have communication.

More happened at the bar than we know...Barb will testify for the defense as a hostile witness or with immunity (not sure for what).

DVD accidently, in anger perhaps, suffocated her with something...possibly the dog bed or the dog in despair at what was happening, did tear it up.

This did not happen in Danielles bedroom, but in the MB.

Danielle was placed in her bed with the bean bag obstructing her view from the door in case she was looked in on.

There were no door incidents that night, those were red herrings to give the appearance of a kidnapping...DVD opened the side door so BVD could attest to a breached door.

After BVD fell asleep, DVD had made arrangements w/UNSUB to come to the house and take Danielle...DVD would not have left her body so uncaringly.

BVD did not know what really happened but has had suspicions...along w/alcohol fog of that night and family preservation based on suspicions, she appears guilty.

DVD knew of her "involvement" or friendship w/DW and played on it from the beginning, using information BVD had mentioned about DW to cast doubt and direct the investigation towards DW from the start.

DVD knew Danielle had been inside the MH in the past, with the inside workings of forensics, Diane Halfman, he suspected they would find some trace of her

In doubt, on 2/3, he placed a shell casing on the floor in her room...had blood not been found in the MH (inside info from Diane), I suspect something matching that casing would have been found in DW's possession.

Diane Halfman was a patrol officer and I don't see her as having high placed contacts in LE, her use was inside info on forensics and the case.

The pressure from the DA to solve this case for political reasons, the steering of info from the VD's and the pressure upon LEO's, resulted in the zeroing in on DW.

Someone as perpetrator, that is. Of course, Danielle was at her home and the MH (at some point).

I suspect he takes receipts that people leave at the pumps as litter...neatnik, ya know.

..it gives the impression that MH was wiped down when they say only 6 latents and none are DW's....where did they print..obvious spots or obscure?

Camped in it all weekend, and only 6 latents, and none are his? Sorry, whether they printed the cab or not, none of his prints in the living area after camping all weekend is highly improbable and points to the conclusion that it WAS wiped down.

He left no prints after getting dirty and sweaty trying to dig himself out? NIMO

Rheo, first let me say you are an absolute treasure for those of us who have an interest in this case with your note taking. We know you have other stuff to do, too, so thanks for the heads-up when you must be away.

Re: Receipts. Even though the receipt "x's out" most of the numbers so people can't pick up someone else's receipt and see their credit card number, the police would certainly be able to trace the number. They would be able to see if the card is his. If it is not, they would be able to see if the parties are affiliated in any way. If DW told them he had a habit of picking up litter, including receipts left behind, the investigation would show that the purchase had nothing to do with DW.

Feldman said he was going to use the prosecutions own evidence to prove DW didn't do it. This could be it. If his expert can use the state's evidence to show that the same unknown person was in the VD house and the MH, that's real reasonable doubt. No, he would not have to let the DA know what his expert had concluded before he took the stand. Seems real suspecious to me that the lab did NOT do this comparison. They were not looking for truth only conviction?

Lot to like there! Remember, BVD hinted around to LE about DW until they got search warrants and then said "I didn't say that!"

I doubt this is it. This guy was asked if HE compared prints. That doesn't mean the prosecution's team of experts didn't do some comparison.

Think for a minute about the surfaces you touch in the course of a day. Do you touch the walls, windows, the floor? I don't. Do you touch door handles? Yes, but they will only hold the last person to touch, even then they might be smeared. Table and counter tops, sure. But these are the same places you expect to get wiped down daily. Nothing sinister here. Clothes, upholstry, bed linens. Sure you touch these, but they don't leave good prints.

I'm amazed how people can say lack of "X" number of prints is suspicious when they have no idea how many prints should be in a typical household or vehicle. Remember, LE did not look at the front of the MH for prints. They knew there would be plenty of DW prints there. so what.

How about jumping up and down on the bed? She slips, falls face-first against the cabinet, and her nose starts to bleed. Her nose drips on the carpet a couple of times, gets on jacket and curtain in much the same way as you've said.

By the way, kids can make their own noses bleed - I've seen it done, much to the embarrassment of the mothers! I can also picture this little girl meandering around this motorhome, whilst meandering around her nose, so to speak. (Ick!) Soon, you have a child with a nosebleed AND blood on her fingers.

And didn't Douglas Pierce say that he overheard the PR ladies talking with Brenda, saying, "What will we do about BVD and Westerfield?" And they clammed up when they saw Pierce in the doorway...

Regarding the MH as playground for Danielle:

I find this unpersuasive because the prosecution has shown the MH had not been in the area close in time to her death. Plus, all this speculation on kids going in the MH has yielded exactly one set of prints from the neighborhood. And they just happen to be Danielle van Dam's. No other children from the neighborhood......too unlikely. Add in the blood (some of her teeth were found in her throat---bleeding from the mouth is what I would think happened)and her hair--in the drain, no less, and it doesn't add up to such evidence being left due to an episode of innocent play.

Well, it seems they have a team effort with lots of specialists. We'll see, John. You reminded me that the defense would not have to turn over to the prosecution their analysis of the prosecution's own evidence-----good point.

The video of Danielle reminded of one of our children that just ran into everything and fell down all the time, still does!

Haircut: I think Danielle's recent haircut is important. Although we all have hairs of different lengths on our heads, the fact that they found no hairs as long as hers were PRE haircut is significant, imo.

Also opportunity.

Did anyone post yet the significance of tests on Danielle's fingernail scrapings? There was no DNA found, more significantly, no DW DNA. So I would say it's virtually impossible that the scratches on DW's wrists came from a struggle with Danielle.

This probably vindicates DW's version of where the scratches came from. Another myth bites the dust.
