WESTERFIELD TRIAL: Week Three - Day Four
San Diego Courtroom Trial
| none
Posted on 06/19/2002 8:45:03 PM PDT by NatureGirl
Here's the new thread, all ready for Thursday.
Testimony recently discussed includes fingerprint evidence, as well as Westerfield's clean laundry. The Van Dam home was (strangely) devoid of fingerprints, except for a couple of latents that didn't match any of the pizza party people or, apparently, David Westerfield.
Westerfield's motorhome didn't contain any of his fingerprints, but did have one print from Danielle L. (the daughter of Westerfield's ex-girlfriend), Jennifer (a friend of Danielle L.), and a partial from Danielle Van Dam.
The prosecution said yesterday that they would be finished "in seven court days".

Oh, and just so I make my position clear: I have not ruled out DW as the murderer, or the "clean-up" man. Anything can happen. I really really doubt that he took her from the VDs house, however. So far there has been no testimony that places him in the Van Dam's house. Remember - that a big part of the prosecution's case is Brenda and Damon's testimony about various doors being open at different times during the night.

Just reading over Feldman's opening again - what does this mean -
"You may see evidence that he has a habit of grabbing things and moving them out of the way."
Is this supposed to account for his losing his wallet?

he has a habit of grabbing things and moving them out of the way."We were at Arlington National Cemetary a few months ago and my 8-year-old was standing at the front of the group of people looking at Kennedy's tomb. A man grabbed hold of his shoulders and firmly moved him out of the way so this man could get up to the front and take a picture. I was miffed, but this man was oblivious to having shoved a child out of his way--he was just focused on getting up front to get his pix.
I can visualize Danielle (and friends?) peering into the MH as it is left open and unattended, then being physically moved out of the way by DW to allow him to continue with his preparations. Not in a malicious manner, but in a "don't bother me, I've got things to do" manner. Just a thought.

It is standard practice for defense attorneys to use their own experts. They are given access to all of the prosecution's test procedures and results. They can accept the results or have their own experts perform tests or just critique the procedure.

Re: #572. If he did he didn't find anything. He has to turn over discovery to the prosecution, too. Also, the print experts were able to tell approximate age and such. Even if they don't compare directly they have taken measurements of each print and would know if something looked similar enough to compare.
No, Feldman just putting questions out there, but in this case I predict there will be no dramatic showing that someone other than DW was at the van Dam home AND in the MH.

Hmmmmmm. Understatement, huh? Well, maybe if I ever get the chance I WILL try it. Thanks. :)

Caviar is heavenly!
I like it plain, just piled on a melba round.
Out of this world!

Could you add me to the ping list? Thanks in advance.

Damon wasn't at home that Friday night (some here have speculated that); -Danielle wakes up, panics, lets herself out of the house (to look for Dad?)and heads out to the street;
-DW roars home drunk, and runs her over;
-DW panics, he's already had a DUI, now he's injured (or killed) a child while driving drunk;
Coupla problems with this. No blunt force trauma to the body per ME testimony. Seems highly improbable that an SUV could hit and kill a seven yr. old without some serious breakage of bones, snapped neck or skull fracture.
Also hard to believe that she didn't bleed heavily from asphalt abrasions. Scent dogs would have found the blood and skin the next day. No way to clean that up sureptitiously.
And if it was an accidental death, why did he dump her NUDE?
