WESTERFIELD TRIAL: Week Three - Day Four

Here's the new thread, all ready for Thursday.

Testimony recently discussed includes fingerprint evidence, as well as Westerfield's clean laundry. The Van Dam home was (strangely) devoid of fingerprints, except for a couple of latents that didn't match any of the pizza party people or, apparently, David Westerfield.

Westerfield's motorhome didn't contain any of his fingerprints, but did have one print from Danielle L. (the daughter of Westerfield's ex-girlfriend), Jennifer (a friend of Danielle L.), and a partial from Danielle Van Dam.

The prosecution said yesterday that they would be finished "in seven court days".

I cannot state for sure. I only know that every time I see the picture of the three of them, it is stated that it is Diane Halfman. By the poster or the news media.

Feldman brought out the fact that FBI labs only perform services for LE

Which is proably for the best, the FBI crime lab has had some serious problems in the recent past.
BTW, could someone put me on the Ping list? I sometimes have difficulty finding the current thread. Till monday then, darn it, just when it was getting interesting. I had even woke up from the presistant coma/fugue-like state I was in. :o)

Today sure looked bad for Westerfield. If it were in some other state and not California, I would say he's practically convicted.

Thank the Lord we get a three day rest.

The strangest part of todays Trial, which I couldn't get all of, was the mention of the blonde hairs and the exclusion of the three blondes.

Should have been easy enough to tell if one of those hairs was chemically treated, which would have immediately EXCLUDED Danielle...but no mention...go figure.

I wonder what about the van Dam lifestyle seems so extravagant? I am talking financially extravagant.

BvD couldn't remember the price of a box of GS cookies-- and yet she was out helping her daughter sell them. OTH, Keith Stone said he thought $6 was a high cover-- he got into Dad's free, as a friend of the band. We don't know if it was a real ladies' nite, or if they avoided the cover by going early. BvD went twice in eight days, that we know and bought drinks. If you start adding it up, it can look extravagant.

-Could she have been watching the kids for Damon while he snuck away?

-Could she have accidenltly killed Danielle?

-Could she have done it to keep Danielle from saying something to Damon when he got back?

-Could the short dark hair be hers?

-Could she have gone to DW's house or into the MH with the detectives? (she says she is a close personal friend of the detectives)

-Could the fingerprint on the handrail be hers ?

-Could she have something to do with the .22 casing?

No, the lady in court with BVD is not Diane Halfman. She was reported to be someone from the prosecutor's office. I'll go back and check around.

See, I cut her a break for the momentary statement that they cost $4 instead of $3 because she was testifying at a murder trial in which her daughter is the deceased. I think we all say statements then correct them, which she did.

As to Dad's. She testified to being there about 4 times in about 2 years or so. I'm going by memory so may be off precisely, but she was no regular. And if you are inclined to not believe her, then I would guess employees of the establishment would be contradicting her. I don't believe we'll be seeing that testimony.

That shell casing is really an oddball. It's almost as if someone was trying to change the direction of the investigation. Was it getting too hot for the VD's? If they don't own a .22, then LE would be forced to look beyond the immediate family.

REMEMBER, this shell casing was found before the body was found. Maybe this led to the early murder charges being filed before the body was found.

Yeah, but she shifted gears from the PH and remembered the name of the dentist. In PH, did they ask her about the cookie price?-- or was that a trick question for the trial? If BvD wasn't a regular at Dad's, maybe she was a regular at Mom's. /sarcasm

Neil would have had access to the MH, just as DW did. But, I wonder, if were somehow Neil (his reported alibi notwithstanding), if DW would be able to reconcile with that possibility, or would the thought of his son doing such a thing be too hard for him to comprehend?

No-- she was excluded-- all the "pizza guys" were-- in fact, they left no fingerprints, after pizza time. Go figure.

That's a good question and maybe you can clarify. Do "contract" employees at Qualcomm receive stock options or other preferential stock-buying treatment? Do they get health insurance for all family members?

I asked someone who knows about consultants, and no, they don't get options or benefits. Benefits/insurance would come from the consultants' company. QC Options are not given to consultants. They do generally get paid LOTS more to compensate, and the consultants' company gets some of the percentage. The quote I had given earlier was for regular employees, but I had added a little for consultants. I may not have added enough because I didn't know they were paid that much more. Apparently, they are.

Earlier I asked UCANSEE to pass along a ??? to Kim - well she has allowed me to post her response to what she thinks about the hair in Danielle's hand -

"We all have to be patient cuz dusek can't explain why he picked this evidence and that evidence... he has to let the expert witnesses, one by one, explain their role in the evidence gathering..and each tech/expert is a step UP towards the conclusion/finger pointing. the prosecution has to let the experts tell the story..he'll summarize it for "the people" in his closing arguments. Dusek simply CAN'T tell the people why or how this piece of evidence fits in the crime, but he can bring forth witnesses who can. If it turns out to be DW's hair in her hand..how is feldman going to explain it away? If it was not DW's hair....wouldn't it have made sense for Dusek to exploit that little fact during opening statement? It seems to be by the fact that the evidence was not ommitted from testimony...or hidden, that it has value for the prosecution. It does not make sense, BUT NOT IMPOSSIBLE that it could be her own hair.. on the other hand, seems that DW's hair is too short to grab and pull. That is ONE of the mysteries I CAN'T WAIT to get solved.. "

You've got a winning theory there - it fits the known facts so well. It isn't necessary to convict DW - just construct a strong enough frame to try him. If you convict him, fine. If not, people will still let the thing go. A similarity to the Colo thing is the apparent "bungling" by people with proven track records of competence in other matters. When a crime surfaces, and powerful people are threatened (like whoever left the still-unidentified DNA on JonBenet's death garment), police can "flake" evidence that'll be credible to other professionals. I believe you've got the theory that accounts for so much otherwise unexplainable behavior. If Danielle was being pimped, it doesn't require LEO participation in the first crime - just in the coverup.
