What Bork never understood is that we don't make free men affirmatively justify their liberties - rather, the burden of proof is, rightly, upon those who would remove those liberties from men to show that society and individuals are better for not having them than for having them. Only slaves can be required to affirmatively justify their liberty to the satisfaction of another...
