Good-Bye Cruel Free Republic

Well, it's been 4 years since I first found Free Republic. I have always felt like I belonged here and have really enjoyed the banter back and forth between us members. I am afraid all this is now over. I am really suprised and shocked at it's suddenness. Before I leave I want to thank a freeper from Michigan who sent me a DVD player last year to give to my kids for Christmas. You reaffirmed my faith in humanity.

I know this thread will be deleted before many people get to read it, but I just can't go without saying a final word. Every since 911 the 'vibe' here at FR has been decidedly hostile. I guess it was a matter of time before the newbie moderator got around to weeding me out for my sometimes unpopular views. So I join the ranks of A+Bert and so many others who gave FR a interesting flavor. I will miss coming here 20 times a day and keeping up on things. But without posting priviledges there is just no point. I must go find another conservative group to try to be a part of.

In the future, when a freeper who has been a loyal member since August 1998 crosses the line, how about a note instead of banning? Would that have been too much? I may have gotten out of line, how is beyond me, but if such a tresspass would have been pointed out I would gladly have refrained from doing so again. It is just not right to just ban an account with no explaination. Especially when the freeper has been here 4 years. I have no idea what I am going to do with my days now that I no longer have FR. Well, I guess I have said my part. It is a sad day when one has to leave family and friends. I feel like some of you were just that. But apparently I am no longer wanted around here. I bid my good day to you all and hope that karma pays it's respects to those who do injustice.

Thank You!

The case was KENNEDY V. MENDOZA-MARTINEZ 372 U.S. 144

It concerned a man with dual citizenship (US/Mexican) who fled to Mexico in 1942 to avoid the draft. After the war he returned to the US where he was arrested and was ordered deported and was also denied a passport to return to the US. (Surely they meant visa?) On the grounds that he had lost his citizenship by remaining outside the US in time of war to avoid military service. (I like this idea. Any chance of resurrecting it?) Here it is in context. I think the whole thing is pretty good

Sorry about the caps and lack of formatting but this is cut from the original document.

WE DEAL WITH THE CONTENDING CONSTITUTIONAL ARGUMENTS IN THE CONTEXT OF CERTAIN BASIC AND SOMETIMES CONFLICTING PRINCIPLES. CITIZENSHIP IS A MOST PRECIOUS RIGHT. IT IS EXPRESSLY GUARANTEED BY THE FOURTEENTH AMENDMENT TO THE CONSTITUTION, WHICH SPEAKS IN THE MOST POSITIVE TERMS. (FN10) THE CONSTITUTION IS SILENT ABOUT THE PERMISSIBILITY OF INVOLUNTARY FORFEITURE OF CITIZENSHIP RIGHTS. (FN11) WHILE IT CONFIRMS CITIZENSHIP RIGHTS, PLAINLY THERE ARE IMPERATIVE OBLIGATIONS OF CITIZENSHIP, PERFORMANCE OF WHICH CONGRESS IN THE EXERCISE OF ITS POWERS MAY CONSTITUTIONALLY EXACT. ONE OF THE MOST IMPORTANT OF THESE IS TO SERVE THE COUNTRY IN TIME OF WAR AND NATIONAL EMERGENCY. THE POWERS OF CONGRESS TO REQUIRE MILITARY SERVICE FOR THE COMMON DEFENSE ARE BROAD AND FAR-REACHING, (FN12) FOR WHILE THE CONSTITUTION PROTECTS AGAINST INVASIONS OF INDIVIDUAL RIGHTS, IT IS NOT A SUICIDE PACT. SIMILARLY, CONGRESS HAS BROAD POWER UNDER THE NECESSARY AND PROPER CLAUSE TO ENACT LEGISLATION FOR THE REGULATION OF FOREIGN AFFAIRS. LATITUDE IN THIS AREA IS NECESSARY TO ENSURE EFFECTUATION OF THIS INDISPENSABLE FUNCTION OF GOVERNMENT. (FN13)

1. My bad...we'll just hold him indefinitely without a trial till he dies of old age.

2. If an honest sincere discussion on political topics is not what Free Republic is about...

Hoo, boy.

Fred, exactly what rights have been denied? His first 30 days was as a material witness and he would answer NO questions, He is now charged as an unlawful combatant and will have a trial. How is that any different from any other person charged with a crime?

I think Jihad Johnny will walk if he is tried and frankly, I think the whole mess will get turned over on appeal, if not. JJ is a twerp, at the very least, but the gov't has come down on him the way the ATF came down on WACO. Way overdone. Sometimes you have to pick your fights. parsy.

Can you imagine what's gonna happen if Johnny Jihad walks?

I for one am going to throw him a party, and give him some nice neckties. Any of you all want to join this 'necktie party'.

Unsigned confessions, he looks like a good kid when you shave and wash him.. He's going to whine about being "tortured" and stuff.. They can't finger him personally for Span's death.

I agree he's probably gonna walk. But considering how, when and where he was caught I think he deserves the Tribunal.

Honestly, if anyone in this mess knowingly and willfully took a dump on their own right's it was Jihad Johnny.

Too bad that some people around here don't support us when we're at war.

HorseHillary! Bin Laden is just the excuse people are using to try and demand we blindly follow Bubba-2 without question. There have been threats like this before, and there will be threats like this again. The only thing that makes that one stand out is that it was more successful than earlier ones. And no matter what steps the governemtn takes, sooner or later there will be another successful attack.

Oh if started lynching twerps and idiots, we'd have to lynch half of California and about 25% of the country. Starbucks all over the country would be deprived of customers. The economy would tank. Harvard and Berkely would become ghost towns. CNN would not have and reporters. This would be a bad thing, wouldn't it? parsy.

Good catch.

We deal with the contending constitutional arguments in the context of certain basic and sometimes conflicting principles. Citizenship is a most precious right. It is expressly guaranteed by the Fourteenth Amendment to the Constitution, which speaks in the most positive terms. The Constitution is silent about the permissibility of involuntary forfeiture of citizenship rights. While it confirms citizenship rights, plainly there are imperative obligations of citizenship, performance of which Congress in the exercise of its powers may constitutionally exact. One of the most important of these is to serve the country in time of war and national emergency. The powers of Congress to require military service for the common defense are broad and far-reaching, for while the Constitution protects against invasions of individual rights, it is not a suicide pact. Similarly, Congress has broad power under the Necessary and Proper Clause to enact legislation for the regulation of foreign affairs. Latitude in this area is necessary to ensure effectuation of this indispensable function of government.

I don't know about Padilla, but Moussaoui was in a lighted cell for 24 hours per day. Sounds like nothing, but for 30 or 45 days, it takes its toll.

Did he get that? I don't think he did.

I thought that he can't talk to lawyers or family.

There are two sides to a story. I would like to hear his.

If I am wrong, please correct me.

TIA

I think that if we restrict it to those who have taken up arms against this country in a war, that will get us down to a reasonable number, don't you?

I have often thought of playing devil's advocate and defending Moussaoui and Padilla's rights; but I just can't bring myself to handle the mental torture. I think I see what you're saying, is all I'm saying.

<<<<<<<<<<<<<

Thanks Fred. I'm not defending these guys I'm defending the constitution. I think all Americans have these rights...even the despicable ones.
