TOW TRUCK DRIVER CLAIMS HE HEARD WESTERFIELD TALKING TO SOMEONE!!!

Phone Records, Witnesses Trace Westerfield's Movements

Witnesses On Day 7 Show Movements

POSTED: 12:56 p.m. PDT June 13, 2002
UPDATED: 2:41 p.m. PDT June 13, 2002

SAN DIEGO -- The prosecution in the David Westerfield murder trial called on a cell phone company employee and several campers Thursday to verify the defendant's whereabouts the weekend Danielle van Dam disappeared.

A series of calls from Westerfield's cell phone in early February appeared to mirror his rambling motor home trip to the beaches of southern San Diego County and the Imperial Valley deserts, Verizon Wireless representative Greg Sheets testified.

But on cross-examination, Westerfield's defense attorney, Steven Feldman, sought to show that the cell phone calls were not a reliable record of Westerfield's locations that weekend. Under questioning by Feldman, Sheets admitted that the records don't give precise locations and don't identify the user of the phone.

Westerfield is charged with kidnapping and murdering Danielle. He could face the death penalty if he's convicted.

The prosecution also called a series of witnesses who were at Silver Strand State Beach on Saturday, Feb. 2. Westerfield said he drove his motor home to Silver Strand that morning.

Beverly Jean Askey of El Cajon testified that her family was already at the beach when a motor home that she later learned was Westerfield's pulled into a nearby space sometime before 10 a.m. It was a nice, sunny day she said, yet no one came out of the vehicle.

"He just pulled up, he pulled the front window closed and I never saw anyone again," Askey said.

Two other campers said they saw Westerfield's motor home and noticed that it appeared closed up.

Earlier, Angela Elkus, a resident of the Sabre Springs neighborhood where the van Dams and Westerfield lived, answered questions about the motor home. She said she had seen children playing around the vehicle three or four times when it was parked on the street, but she said they were mostly older children. She also talked about a visit to the van Dam home after Danielle disappeared.

Elkus said she had never been to the home before, but she brought food over for the family on the Sunday after the little girl disappeared. She said that the family's dog appeared "scared, shy, confused and perfectly still" when she came in the house, and it did not bark, she said. Legal analysts say prosecutors want to convince the jury that a stranger could have come into the house and taken Danielle without the dog barking.

If relegated to a kennel life ...

Was it Rich Brady or Keith Stone that said he knew the VDs had a dog but kept it in a kennel or cage most of the time? I keep getting those 2 confused but I know ONE of them said it.

Maybe this time, he got the wrong info.

The wrong info regarding the doors? I thought that they did take the doors out of the house. If they can place him in the house, there's almost no reason to hear about how all of these people saw him here & there in the desert & his curtains/blinds were closed.

I guess it would take all the fun out of the speculation part of this puzzle. If, as Rick suggested, DW was waiting in closets for the entire party to break up and everyone to go to bed, and then he carried her down a lit street, well, he wins the prize for the most brazen, bold person I've ever heard about.

If you're implying that Barbara did the dirty deed and he helped her dispose of the body, I don't think he's stupid and certainly doesn't owe her a favor (that we know of). In fact, I think he'd turn her in.

I still think DVD did it during the time that Brenda was at Dad's.

The ramps belonged to the tt driver. W left some wood, like firewood.

Thank you Jrabbit.

This is exactly the kind of MISINFORMATION that has been going on through out this whole case. The press or a witness leaks some info that sounds damning to the defense, conveniently leaving out the other details that explain quite clearly the truth of the situation.

Just goes to prove what I said in an earlier post, CYNCOOPER, that human beings have selective memories.

Either yours was selective, or you missed the explanation by the TT Driver about the ramps, or you purposely ignored it(which I doubt, as you seem a fairly honest person).

Well, Rick Roberts has been right with his LE sources before. He has done a 180 turn-around recently

Maybe this is because his high-placed LE sources are under a gag order now. Now wonder he did a 180, he is guessing.

The guy said they were DW's and he took off without them and so the guy went to store where he thought DW might be (I missed why he had this thought) and didn't see him there so he took them back to his place and DW never picked them up. Others can verify this testimony if they care to or you can check the transcript when it is up.

As far as the implication, I am getting that is what all the posters here think is the inference. It may be what the prosecution is getting at, I do not know. It is not MY conclusion.

The ramps were DW's.

And.... you are getting this from what ? What testimony, or source?

I heard the driver state, That the ramps were his, that DW had some pieces of wood like firewood he was using to help get unstuck. Busted up folding chairs, if made out of wood, might also resemble firewood.

So, please state your source of that knowledge so we can all be clear.

Someone needs to ask RR which closet DW was hiding in.....Did you see the pictures of the closet in Danielle's room? No standing room............Then again, did the FBI dog with a "heck of a nose" pick up DW's scent in Danielle's room and we haven't heard that yet?

Do you know the witness line up for Monday?

OK. Thank you. I will do so, as we heard different things, but as you probably got to pay closer attention to the testimony than I know I did, you are probably correct. I will defer to you on this matter for now.

The fact that he left in a hurry, and left his ramps could be suspicious, or could be because he had been stuck there, was tired and wanted to get out of there.

So, actually we have another case of something that is disregardable. NO PROOF, NO FACTUAL EVIDENCE of any wrongdoing at all. True?

As I said, wonder when the prosecution is going to come up with REAL EVIDENCE?

See my post above detailing how the guy testified today about DW taking off without his ramps (they were levelers but the MH has the hydraulic kind so DW just had them for whatever reason). Then the guy talked about going to a store to see if he could catch up with DW to return his property to him and doesn't see him. So he takes the ramps home and DW doesn't pick them up.

I agree with you, can't believe this man that didn't want to take back money he had overpaid would stoop that low. Wouldn't use another mans water to fill his MH tank, not a sponger either.

Did you see the June 4th transcripts?

I saw the June 4th transcripts but the afternoon testimony after the break was missing. I haven't checked back since to see if it was added. I wanted to see the complete testimony of both searchers in order to verify whether I heard something correctly.

After freeing the motorhome, Westerfield drove out. Conklin noticed the defendant had left the levelers behind for his RV.
