Moussaoui's judge is trying to force the government to reveal where it is getting its information on him, something the government clearly does not want to do, nor should it.
Your comparing apples to watermellons. Now I completely understand protecting sources and methods, more than you realize. However, Moussaoui's has been charged and is being tried by a US COURT! By the laws of the United States as provided for by the Constitution of the United States. I can understand why the US Attorney is doing what he he doing. In the case of Abdullah Al Mujahir a US Citizen who is being detained without being charged and has now been turned over to DOD with no Military Tribunal established is a hold different story. The US Attorney in the Moussaoui case has formal charges.
So what is the real story with Abdullah Al Mujahir?
His status (charges) changes. He was picked up on a weapons charge or something like that...but than Zebadyah sang, and Mujahir confessed....now it's charges amounting to treason. The DOJ apparently thinks it has a case to prove treason...maybe there are two more eyewitnesses to back up Mujahir's confesseion and Zebadyah's testimony. I don't know. But if the DOJ believes it's got a good enough case to warrent such a transfer, I'm willing to believe it.
