Thank you KC, I totally agree. For the life of me I cannot figure how a US Attorney could not get his guy charges and held as a National Security Threat to the United States. This just doesn't make any sense. Your a lawyer you know that a Prosecutor can indict a meatball sandwich. What happened here?

I also agree that suspening the habeas corpus provisions is very dangerous, but in reality that is actually what has happened. I do not bleed for this piece if trash, but in doing what the Administration has done endangers the rights of all Americans not to mention having real lousy caselaw to support this move. In the 1942 case, there was a established lawful Military Tribunal. it was charged with trying Americans. In this case there is no such tribunal established for "Americans". Additionally there are no charges rendered against this guy and none planned. One has to ask, if as the President said that this guy is a threat, then why has he not been charged? Yes they are holding him because he is not talking, but thats not the point. The points is that habeas corpus seems to have been suspended and if we are going to do that then the President needs to explain this to the public.

Lastly, if the US Government does this in this case, where else will they? Why don't they just change the Military Tribunals to handle Americans? Why screw with the US Constitution?

Please, don't burden the Lawyerly Profession by assuming that I am in their ranks....LOL. It is possible that the exposure of sources is part of the motivation, I will give them that. But we are in a troubled time either way.

Yes the protection of sources and methods had a lot to do with this. But we have a process, like it or not. If you don't like the process, change it, not screw with it. It is very simple, with a stroke of a pen the President can have Americans tried by the Military in certain cases. DO IT! Not screw with it. We set dangerous presidencies when we do crap like this. If Clinton did this all hell would have broken out. Not everyone in the Bush Adminsitration is trustworthy.

If your not a lawyer, I am sorry I took it as you were one. If you are one good luck!

Sorry everyone, this is where this post was meant to go.

This thread has almost 900 posts and no-one else has mentioned that an American citizen, of Puerto Rican descent, acting as a terrorist is not a new phenomenon. Bill Clinton recently pardoned 17 of them, prior to his leaving office.

I'm dying to ask why no one has brought up the Clinton pardon of the 17 Puerto Rican Terrorists?

Here's an article, from August 9, 2001, about 4 more Puerto Rican terrorists that were arrested after they FIRE BOMBED a Navy convoy on the island of Vieques, Puerto Rico.

4 Protesters held for allegedly throwing Molotov cocktails at Navy on Vieques!

There is a significant percentage of Puerto Ricans on the island and stateside that do not feel any allegiance to the United States, harbor a long-festering resentment of the USA and wish us harm.

There is a terrorist group on the island, Los Macheteros, that has been threatening terrorist acts against United States property and non-Puerto Rican Americans for decades.

I wouldn't be surprised, if significant inroads have been made by ME terrorist organizations to recruit from the ranks of the Macheteros and the Marxist/Independence student groups.

This island should be gone through from one end to the other, by our anti-terrorist units, and all members of the Macheteros rounded up and interrogated. The Marxist/Independentistas and Arab/Puerto Rican community should be checked out, too.

Here's some comments made by a few members of the Puerto Rican/Arab community, from the town of Rio Piedras, just days after 9/11.

Puerto Rico: Arabs point out flaws of U.S. Policies in Mideast!

Puerto Rico is easy to enter and, from there, the rest of the United States is just an airplane or boat ride away. It's estimated that as much as 45% of all illegal, recreational narcotics entering the United States come through Puerto Rico.

What else could be in those containers?!!

Conspiracy to kill Americans, conspiracy to commit a terrorist act, conspiracy to obtain and use a weapon of mass distruction, a few charges I know I've forgotten....probably conspiring with the enemy (treason) and possibly conspiring with a foreign power to kill Americans (treason).

I think what we do with this rascal will be very telling on how serious we are as a nation. If there is sufficient evidnece that he did the things he is accused of, and, that is not a capitol offence, what is?

After all, we are at war and he is essentially a spy, and much worse, a potential mass murderer.

As far as the windows go, we're still not certain whether or not it's theoretically possible to wash them. As you know, the first step in a proof is to make certain that it's possible...
