So, let's outlaw EVERYTHING that MIGHT cause an accident SOMEDAY. How's that? Will THAT make you feel better? People die from walking down stairs with shoelaces untied..perhaps THAT needs to be outlawed, too. Where does it end?

Where does it end?Who knows?
What we do know is that there a lot of people who can't drive and talk on a cell phone at the same time.
Anyone can see this.
(Unless they are talking on a cell phone and don't notice?)

"Will THAT make you feel better?"
What is it with this huge emotional attachment you have to your cell-phone?
Let it go, man.
You can't drive while sucking down a bottle of whiskey, either, but that doesn't mean we live in a Police state.
A little rational perspective, huh!

Oh, well, the Americans with Disabilities Act is already trying to outlaw stairs! You're too late with that idea.
I don't mind you driving down the road with a cell phone stuck in your ear if you don't mind me tossing ball bearings out the car window in front of you!

I believe that drivers busy cradling a phone and chatting are not devoting their full attention to driving. While simply chatting diverts one's attention, when coupled with using one's hands for other than driving it increases the chance of an accident. If you must chat, simply get a hands-free set of some sort. And, personally, I think it should be illegal to chat on a cell phone and drive in the left lane of an interstate ...

If you are stupid enough to walk down the stairs with your shoe untied that's your problem. No one will be hurt but you. When you are driving a car and doing anything that distracts you from your driving you are endangering other people. Actually, there are very few accidents anyway. Accidents are not avoidable. Car crashes are avoidable for the most part, if people would just pay attention to driving. We need start treating crashes as the crimes they are instead of "accidents". What on earth do so many people have to talk about that is so important anyway??
