AMNESTY by BUSH - The Truth about Section 245(i)

President Bush is asking Congress to revive an expired law that would grant amnesty to foreigners who came to United States on temporary visas—such as tourist, work or student visas—and then stayed here to become illegal immigrants.

The extension the President is asking for would offer a fourth chance to aliens who first overstayed their visas, then failed to take advantage of an initial amnesty, then failed to take advantage of a four-month extension of that amnesty that ended on April 30.

The provision, the 245(i) program, was set to expire last year when President Clinton successfully lobbied Congress to extend it into this year.

The program requires immigrants to pay a $1,000 fine before their status can be adjusted.

In a May 1 letter to the congressional leadership, Bush said that there were 200,000 people eligible to take advantage of 245(i) who failed to do so by the extended deadline. "It remains in our national interest to legitimize those resident immigrants eligible for legal status, and to welcome them as full participants in our society," he wrote.

"According to agency estimates, there are more than 500,000 undocumented immigrants in the country who are eligible to become legal permanent residents, primarily because of their family relationship with a citizen or legal permanent resident," wrote Bush. "However, the law generally requires them to go back to their home country to obtain a visa, and once they do so, they are barred from returning to the United States for up to 10 years.

"Many choose to risk remaining here illegally rather than to be separated from their families for those many years," said Bush. "I encourage the Congress to consider whether there was adequate time for persons eligible under section 245(i) to apply for adjustment of status before the filing deadline expired yesterday. Information indicates an estimated 200,000 were eligible to file but did not meet the deadline." Bush did not specify how long the new extension should last.

Rep. Lamar Smith (R.-Tex.) led the fight against Clinton’s efforts to extend 245(i) last year. But, in the end, Smith agreed to a four-month extension. Now, Smith says he believes the INS did not handle the four-month extension properly and that there should be another extension. "Because the INS failed to publish regulations in a timely manner, fairness requires that eligible applicants receive their entitled four months, but extending the deadline any further only serves as an open invitation to illegal immigration," said Smith in a statement.

‘Rewarding Illegal Behavior’

"Additional time beyond what was already established only rewards aliens who have broken our immigration laws and is unfair to those aliens who do respect our immigration laws by waiting in their home countries," said the statement.

Dan Stein, executive director of the Federation for American Immigration Reform said, "Besides rewarding illegal behavior, Section 245(i) would allow illegal aliens to circumvent the re-entry bar established by Congress in 1996 that ties an alien’s ability to legally reside in the U.S. to their willingness to obey the law. With six million illegal aliens currently in the U.S., Congress should not cut any deals which could further undermine immigration law enforcement."

Bush’s decision to seek a further extension of 245(i) came four days after he extended Temporary Protected Status (TPS) to illegal immigrants from Honduras and Nicaragua. Bush said that "both countries remain unable to handle adequately the return of its nationals" because of a December 1998 hurricane.

But deliberately cloaked in the bill — the first attempted passage was, in fact, to be by unrecorded vote — was the highly controversial Section 245(i) amendment to the immigration law, which allows "undocumented" immigrants (who, to employ plainer talk, are really illegal aliens) to immediately get permanent residency. All they need to do is pay the federal government $1,000 and have a close relative or employer sponsor them.

This decision gives people who come here illegally the ability to skirt American law, to move to the front of the line because they have skirted that law, and to avoid any real check on their past. Without it, they would have to return to their own countries, apply legally, probably wait up to 10 years and go through at least the minimal check of experienced visa and consular officers in the American Embassies.

The fact that this entire scenario was cloaked in the secrecy and deception of a spy novel — it was included in the day's "suspension calendar," which is generally reserved for noncontroversial matters — demonstrates the degree to which the administration is trying to advance its idea of amnesty for hundreds of thousands of illegal aliens in America, perhaps up to 9 million."

They are enemies of freedom and the Constitution. I know what George Washington and Thomas Jefferson would want to do with them.

Thanks for the compilation...it provides all the information to discount those who support legalizing illegals.

The basics...the US doesn't need more people, we need to train and acclimate all of those who are already here to the language, laws, work ethic, and community spirit we all prize. The terrorists didn't get on planes and get trained in flight school in Afghanistan, it happened right here. The correct response, logically, would have been to shut the borders, tight, and send home both legals and others as soon as their permission to be here expired.

It's not prejudice that motivates these feelings...it's common sense.

I missed most of his statements, but I thought I heard him refer to the illegals as legal. If so, he was looking directly into the cameras and lying to the American Public. Does anyone have the text of this exchange with media?

Rep. Luis Gutierrez (D.-Ill.) thinks illegal immigration is great for America. Philanthropist that he is, the congressman wants to give us more of a good thing.

Gutierrez has filed legislation to allow virtually every illegal alien in the country (an estimated five million) to stay.

Those who arrived before Feb. 6, 1996, would immediately qualify for a green card. Those who came between that date and Feb. 6, 2001, could apply for legal residency after five years.

People in this country know they are benefiting from the work of undocumented workers," Gutierrez argues. "Why not grant them the dignity and justice that comes with permanent legal residency?" Dignity and justice are euphemisms for government benefits and the ability to bring in their relatives.

A Gutierrez aide says illegals are doing "essential jobs" and Heaven help the economy if–spurred by our ingratitude–they go home. And what do we do with these largely uneducated, untrained workers if the economy heads south, as indicators suggest it might?

Instead of benefits, Americans are more apt to associate illegal immigration with words like "crime," "disease" and "loss of national identity."

Contagious diseases like tuberculosis and leprosy are reappearing in this country, thanks to illegal immigration. Peter Brimlow, author of Alien Nation, reports that several years ago, senior probation officers in Orange County, Calif., estimated that up to 80% of their cases involved illegals.

Amnesties tell inhabitants of the impoverished Third World that, if they can sneak past the Border Patrol, Uncle Softie will eventually welcome them with open arms.

They also say to the foreigners who are patiently waiting for permission to immigrate (sometimes up to 18 years): "Suckers!"

The Immigration Reform and Control Act of 1986 amnestied 2.8 million. According to the Immigration and Naturalization Service (INS), there are more illegals in the country now.

Amnestied aliens can immediately sponsor their spouses and dependent children for residence. If they become citizens, they can sponsor parents and siblings.

It’s difficult to get demographics on "undocumented workers." (If someone breaks into your house, is he an "uninvited guest"?) However, in 1992 the INS surveyed those amnestied in 1986. Only 15% spoke English, though all had been here for at least a decade; 80% used public health services. On average, they had a seventh-grade education.

Democrats support this dubious contribution to the general welfare, with a wink and a nod, because they directly benefit from the support of ethnic lobbies eager to increase their numbers.

Republicans lack the courage to do anything positive about the problem, though most in Congress oppose mass amnesties. They are convinced that by keeping a low profile they can do better with the Hispanic vote.

In the past campaign, President Bush refused to support initiatives to end bilingual education or recognize English as our official language. He ended up with about 35% of the Latino vote and congratulated himself for improving the Republican position.

However, as the National Review’s John O’Sullivan notes, this still means that for every 100 illegal immigrants who come here (most from South of the border) and become citizens, the GOP will have a net loss of 30 votes.

By not defending our sovereignty, Republicans miss an opportunity to appeal to the majority of Americans who understand that illegal immigration undermines national identity. (Bush took only 5% of the white vote in 2000.) It’s also a way to court lower-income blacks, the chief victims of cheap illegal-immigrant labor.

On February 16, Bush is scheduled to meet with Mexican President Vicente Fox, who will press him to be lenient with Mexicans who’ve infiltrated the United States. During the election, Dubya said, "I’m not prepared to embrace amnesty because I don’t think the commitment’s there yet to do anything on the border." This is Bush-speak for: We have to plug our porous border before we can consider compassion for lawbreakers.

The American people are the problem. To even come close to fixing that problem would take a winning bloody revolution, and 3 to 4 decades of serious repair.

So you spend your time on a website trying to incite people towards a bloody revolution.

Thanks, it is always helpful when people make their motives and agendas perfectly clear.

A person who wants to inspire a revolution in the United States would be willing to say or do anything, regardless of truth, regardless of who is in power, to acheive the goal.
