Son sues suspect in windshield fatality

FORT WORTH - The son of a man who was hit by a car in October and then reportedly left trapped in the windshield until he died has sued the woman charged in the death.

Brandon Biggs, the son of Gregory Glenn Biggs, filed suit against Chante Mallard this week in state district court in Fort Worth.

The suit does not specify the amount of damages sought, said Roland Johnson, attorney for Brandon Biggs, 19, who lives with his grandparents in Albany.

"He's spent his senior year finding out that his dad was murdered," Johnson said. "He had to do the last rites by himself, and now he's learning these facts based on the police investigation.

"The law allows him to be compensated if somebody has wrongfully killed his dad."

Mallard is in the Tarrant County Jail with bail set at $250,000. She is charged with murder in the death of Biggs, 37, whose body was found Oct. 27 in Cobb Park.

Mallard hit Biggs as she was driving near the East Loop 820 and U.S. 287 split, police say. She drove home with the man lying on her car stuck in the windshield. Mallard told police she parked the car in the garage and apologized to Biggs but never sought help.

After he died, friends of Mallard, whom police are still seeking, dumped the body in Cobb Park, police said.

Brandon Biggs' suit contends that Mallard's "grossly negligent actions" led to his father's death. She "had a duty to render aid and seek medical help" while Gregory Biggs was "helpless" in her garage, the suit states.

Initial reports to police indicated that Gregory Biggs might have lived two or three days in the garage. However, Tarrant County Medical Examiner Nizam Peerwani said this week that the man likely lived only a few hours.

Brandon Biggs declined to comment on the suit.

Gregory Biggs, a self-employed bricklayer, had been homeless for about two years. Brandon Biggs has said he occasionally visited his father at a shelter on East Lancaster Avenue.

When told by authorities that his father's body had been found in the park, Brandon Biggs made funeral arrangements. He has said he could not find other family members.

Last week, Brandon Biggs said he wanted to meet Mallard to better understand what she did and he wanted to pray for her.

"His feelings haven't changed at all," Johnson said. "He still wishes to talk to her someday and to learn and help the healing process. This is especially important because Brandon was the closest person to his dad and, while his dad was alive, he tried to stay close as best he could.

"But we all have consequences for our actions."

ppaul's #55, which I just read, would suggest that the bondsman's position might be more favorable than would be the case if her real estate were encumbered in connection with a civil action...

Liability Exclusions in the Texas HO policy:

1.Personal Liability and Medical Payments do not apply to;
a. Bodily Injury or Property Damage which is caused intentionally by or at the direction of the insured

f. Bodily Injury or Property Damage arising out of the ownership, maintenance, operation, use, loading or unloading of 1)motor or engine propelled vehicles ... which are owned or operated by or rented or loaned to an insured.

The original accident would be covered by the auto policy to some degree. Getting into the Homeowners policy is going to be more difficult. By the time she got him to her garage, she has broken the law by not rendering aid. Her decision not to call for help is an intentional act, in my opinion.

Not saying it won't happen. I've been surprised before.

"I saw him on The Today Show. It was painfully obvious that he wasn't very bright. I was outraged at what this women had done to his poor father, but it didn't seem to faze him. He mentioned that he called his mother, and she had seen the account on television. I wonder why his mother couldn't handle the funeral or even attend it."

Thanks for the insight. This mess reads worse than a Greek tragedy.

Thanks for the heads up. This whole case is both sad and just plain gross at the same time.

The only danger I see is that if a civil suit is launched this early, it might jeopardize the actual criminal case launched by the state. But if his son feels he can obtain some level of justice with this lawsuit, more power to him.

Yea a few hehe. My grand mother used to live on the street her house is on.

I guess the son Biggs needs to get a suit going to keep the property from changing hands. It want be in her name long is my guess. Unless the lawyer can stop it from being sold or taken out of her name.

Most of us like to tell jokes about our friends the lawyers, but, I sure I am glad they are around to help us when we need them.

I'm no legal eagle, but it's my guess that any shenanigans they pull at this point would be negated by the courts as a ploy to evade judgement and wouldn't stand.

Most of us like to tell jokes about our friends the lawyers, but, I sure I am glad they are around to help us when we need them.

Well, I've known and dealt with a few "officers of the court" over the years, and I wouldn't give you ten cents for the lot. It seems the profession has changed dramatically over the last 30 - 40 years or so. Same holds for M.D.'s IMO. At one time, one could expect pretty much the straight skinny from these two groups, but now..... I hope my experiences are the exception rather than the rule.

1) dui person hits innocent with vehicle 2) dui person LEAVES SCENE with injured 3) dui person lets innocent suffer for long period of time. She caused his death- that's it. Fry her or lock her up 'till doomsday and be done with it.

You have made a circular argument. Please tell me why there should be any compensation for non-dependents. Seeing justice done should be compensation enough for this young man who needs to get on with his life.

Now, for the sake of appearing reasonable, I could stretch the idea of "dependent" to include parents suing for the death of a child, who has had x amount of dollars invested in its future with y years of potential income, of which z% of that income could have been used to pay for its parents' future needs in old age or disability. But the parents could not collect anything beyond funeral expenses until they reached a certain age, and the lawyers would have to wait for their chunk too. The money would be escrowed, and if the parents died before old age or disability occurred, there would be no award. There would be none of this retiring at 25 and going on a cruise to Tahiti when one's two-year old gets run over by a moving van.

She owns a house. I believe her parents bought it for her.

???? Earlier reports from her bail hearing had her parents admitting they hadn't heard from her but a couple of times in the last 2 years,and not even knowing where she lived or where she worked. She lived with her boyfriend,so maybe it was his house? Most likely it was a rental.

Conspiracy to commit murder is a slam-dunk,and I'm wondering why her boyfriend isn't in jail for this already. She took him out to the garage to show off her new hood ornament right after they had sex,and it's obvious he conspired with her to deny this man medical care. It's also likely he was involved in dumping the body,another conspiracy charge.

? BTW,let's not forget "torture" charges either,as the man was surely being tortured by her and her boyfriend coming out to the garage several times to look at him as he lay there begging for help. They didn't even get him a glass of water to help with the shock,or a aspirin for the pain. Add to that gross neglect for human life,or whatever is the official charge for that offense. All they had to have done was picked him up then in another car and dropped him off close to a fire dept,rescue squad,or hospital and call 911 to have saved his life. It wouldn't have cost either of them anything,as he was in no shape to be identifying them or claiming he had seen anything other than the interior of her car and garage.

IMHO,the "torture" charges make this one of the "special cases" when a capital charge is justified.

I thought of that too......no one would let even a dog or horse die like this.....this is so disgusting and heinous....I really hope she gets the death penalty.

Perhaps you are correct. She does however, own the house, or so I'm told.
In any case, she murdered his father. How about suing on pure and simple principle??
