WASHINGTON - The Democratic-controlled Senate Judiciary Committee voted along party lines Thursday to kill the nomination of Judge Charles Pickering to the appeals court, handing President Bush a stinging defeat in a racially-charged confirmation battle.

In a series of roll calls, the panel also snubbed Bush's request to allow a vote in the full Senate on Pickering, a 64-year-old Mississippian with more than a decade on the bench.

Libertarians must realize that they are handing the country to the Dems. Libertarians are a greater threat to the GOP than the Naderites are to the Dems. Most new libertarians are GOPers who were offended over some real or imagined GOP defection. It is time to get over it, grow up, and realize that sometimes people in politics disappoint you. It doesn't mean that you pick up your marbles and desert the team. It is time for you Libertarians nee Republicans to come home and help save the party and the country.

I am not suggesting that Judge Pickering is the ONLY qualified judge... however the principle is that he IS entitled to a vote of the FULL Senate, keeps our Senators from avoiding the appearance of playing "party politics" if they are not FORCED to vote UP or DOWN.. that IS the issue here..

Do you think for one minute a Democrat attorney general would not have contested awarding the election to a dead candidate's spouse ?

And rightfully so; the Republican Ashcroft was derelict to allow the widow a Senate seat as though the wife ran for election instead of the husband.

Complain about Jim "swithceroo" Jeffords, John "I lost to a rotting corpse" Ashcroft, and Rick "I lost to a carpetbagger" Lazio all you want.

There is only one person TRULY to blame for the dems controlling the Senate: Mitch McConnell.

As chairman of the RSC from 1997-2000, he SINGLEHANDEDLY took a 55-45 Republican majority and gave it to the Dems. If ou remember, all the talk in 1998 was about the Reps getting a filibuster-proof majority- they broke even. He refused to help Linda Smith in her bid against Patty Murray- all because of her stance on campaign finance. Schumer had no business beating D'Amato. In 2000, Reps lost WAY too many seats than they should have. All this falls on McConnell's shoulders, and he's the one that needs to be held accountable.

True Libertarian Party members are a small factional entity in the big picture and this has always been the case. In the last general election, LP prez candidate Harry Browne, recieved about 390,000 votes. That was a drop from 1996, when he garnered 485,000. The best an LP candidate has ever done, was Ed Clark's 921,000 in 1980.

Members of the Republican Liberty Caucus, who consider themselves libertarians and republicans, show no intention of breaking with the Republican Party.

FreeRepublic happens to be a home for many activist libertarians, I think you may be getting a false impression of their strength and numbers.

Mitch McConnell can be very difficult at times, but he is a tough, no nonsense conservative Republican. McConnell's ACU rating was 96 in 2001 and 100 in 2000. Overall he has an 89 lifetime rating from the ACU.

We need more people like Mitch McConnell in the Senate.

The redefinition of the advise and consent role of the senate to include an Orwellian probe into the political leanings of nominees is an unprincipled abuse of the Constitution.

We have American sons and daughters fighting and dying to preserve the Constitution, but the disordered minds of a craven pack of liberal barbarians figuratively scrawl across that priceless document with their crayons.

Intolerable.

Usurping Executive branch powers to serve momentary political expediency is the act of an unprincipled child. When unprincipled children behave poorly they are corrected, when foolish children reach out and grap a hot pan they get a painful burn. When similarly unsocialized socialists behave poorly there has to be some kind of corrective feedback.

Call Rush, call your congressfolks, make some noise here, the issue of legal sanctions for creating a constitutional crisis needs to be raised. At the very least a civil action should be brought against the senate judiciary committee by the executive branch seeking restoration of the constitutionally defined roles of the branches of government.

If we let this stand the constitution is going to gather more crayon edits, either correct the barbarians or stand by for more barbarism.

Pretty simple stuff.

Is it illegal to make a Supreme Court appointment when the Senate is in recess? Probably.

W needs to take this issue to the Supremes, and get it out of the arena of arguing with the Senate.

A committee should not be approving the nominees.

The Senate should be approving the nominees.

It's a constitutional question, which, last time I checked, the Supremes should referree.

For your information, Mister Liberal, what republicans and conservatives want, is a full floor vote by the entire US Senate and not some nonsense coming out of a committee. It has already been stated on this thread, there is nothing in the Constitution that says, 'with the advice and consent of the Senate judiciary committee'. The Constitution specifically states:

"He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court,and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments."
Article II, Section 2, US Constitution

Nothing there about a committee - Senate would mean all 100 senators.

You're full of crap Mister Liberal. Moderates don't really stand for anything. They go with the flow. Liberals want more taxation and bigger government. Conservatives want smaller government and less taxation. It's that simple. The same political gamesmanship applies to presidential nominations for judges/justices. Liberal jurists have a proclivity to interpret the Constitution to suite their social agenda. Conservative jurists would rather leave the Constitution alone and not create law from the bench.

Judge Pickering is an honorable man and has been a good lower court judge for the last thriry years. He has wide support among Democrats and black leaders in his home state of Mississippi. The full Senate should be allowed to vote on Pickering's qualifications to serve and not on some leftwing distortion of his actual voting record.

Please, sir, you scrawl across the sterling record of Judge Pickering with the same abandon with which the barbarians on the judiciary committee deface the Constitution.

Creating a caracature of Judge Pickering and then hurling abuse and unsupported smears against this false representation is a revoltingly propagandistic activity which resides far below the level of discourse which is required to express good faith and citizenship.

In point of fact, Judge Pickering testified against the KKK when he knew is could cost him his life, and the lives of his wife and child.. He enjoys the staunch support of the African American community in his home state in no small part because he is a hero of the struggle for civil rights.

Do you have any comparably sterling testaments to your courage and character? Or are you heaping vitriolic abuse on a man who is your better?

Judge Pickering enjoyed UNANYMOUS support when he was nominated to the federal bench ten years ago, he is seldom reversed. His sterling credentials are endorsed even by leftist fanatics at the ABA.

Churlish behavior by the left is expected when the media fails its function as the fourth estate, but being a churl is not a condition which will pass here unremarked.

The issue is not Judge Pickering, it is the unprincipled assault upon the Constitution on the part of minuscule intellects who would destroy this republic for a transient advantage in political games.

His record is fine, but the fact remains that when he took over the RSC, the reps had a 55-45 majority and all signs suggested that Republicans would pick up more in 98. It was 50-50 after 2000 when he stepped down. McConnell could do nothing about Coverdell dying and having his seat filled by Miller. The other seats- plus all the missed opportunities to take over Dem seats- do fall squarely on him. As good of a conservative as he has been- that is how lousy of a RSC chariman he was- and Pickering has payed dearly for McConnell's impotence. There is no getting around that.
