Sounds like time to throw the book at someone, then stack the sentences, and then bring on a federal trial for having denied the decedent his civil rights, and let her do some federal time while waiting to come home to the state time.
That's if they can't do better than a five-year charge. What about voluntary manslaughter? Second-degree murder?
I want some videotape of this guy's dead body with MLK's "I Have a Dream" speech booming in the background. About how people were all going to be nice to one another.

Relatively vastly trivial aside: when I was in grammar school, a lady backed her car over me.
I had stopped my bike when I saw she was about to back out. I saw her look in ther rearview mirror, then stop. I figured she'd seen me, so I went on. When I was mostly past, she resumed backing up (she'd only been applying makeup as it turned out, as I recall). She kocked me down and I was pinned under my bike, which she backed over (back tire).
She looked out and saw what she had done.
Then she pulled forward...running over me again.
Surprisingly, I was mostly unhurt.
And now for the punchline.
She was on her way to nursing class!
