A Foster City genetic researcher killed his former employer and himself Wednesday with a cheap gun he had purchased legally and registered with the state, investigators said yesterday.
Police would not disclose, however, when the researcher, Guyang Matthew Huang, bought the gun, a Bryco Arms Jennings .380, which they described as a relatively inexpensive weapon that an inexperienced buyer might purchase for personal protection.

No one ever said that a background check will keep someone from committing murder or suicide. I suppose they would feel better if he has pusher his boss out a window & then jumped to his death?
When a gun that was purchased without a background check is used in a crime, it is "proof" that all transfers must be made with the check.
When a gun is used in a crime that was obtained with a check, but was otherwise unregistered or unlicensed it is "proof" that all guns need registration and/or licensing.
And when a registered, background-checked gun is used in a crime, it's proof that that particular type of gun (handgun, "assault weapon," "junk" gun, etc.) needs to be banned.
There is no level of governmental control or restriction that is sufficient for them, such that when that level of control is reached, the focus is no longer on additional restrictions. Since pushes for more control will always come, it is vital to always resist them.
They may not have said it in so many words, although I believe they did, but they certainly implied that it would. They certainly didn't tell the truth. That criminals get their guns on the street, not from dealers, and that the check is simply the first step to registration and then to confiscation. It also has the effect of forcing the people get government permission before exercising a Constitutional right.
A cheap gun is better than no gun, if that is the only alternative. Although I wouldn't go the .380 route, since at least one of these "cheap gun" makers make a .45 ACP, as well as a .40S&W.

If only there were restrictions on magazines with capacities >10 rounds, this would have never happened.
Now isn't that special. Smells very fishy to me.
First of all, my recollection is that the Bryco .380 is 6+1 capacity. If the magazine has six rounds, it was loaded after it was last fired. Rather odd for a guy who just shot himself.
Even if the magazine had a seven-round capacity, it would be very odd for someone to reload the magazine after shooting someone and before shooting himself. Had he shot the gun dry into his victim and then reloaded before shooting himself that would be plausible, but if he'd shot the gun dry he would have had to load the magazine, chamber a round, remove the magazine, top it off, and then replace it. That really seems unlikely to me.
Either the media is misreporting something (no surprise there) or something really stinks in this case.
Perhaps this guy had a J-48. Still, very odd that he would have topped off the magazine of a gun that was already loaded before shooting himself.
