Apparent remains of Danielle found

'It is a high probability it is her,' police sayDanielle van Dam

SIGNONSANDIEGO

February 27, 2002

EL CAJON – The remains of a young girl were discovered Wednesday afternoon off Dehesa Road near the Singing Hills golf course by searchers looking for 7-year-old Danielle van Dam, missing from her home for more than three weeks.

"It is a high probability it is her," said Lt. Jim Collins, a San Diego police investigator at the scene.

Forensic investigators photographed the scene, and other evidence collection was expected to continue through the night as lighting equipment and generators were brought in. Authorities said it was likely that the body would not be recovered until Thursday.

The remains were found 25 to 30 feet off the road among a cluster of oak trees in a grassy area, across from a quarry east of the Singing Hills Resort and Country Club.

A group of searchers from the Danielle Recovery Center discovered the body after 2 p.m. and immediately called sheriff's deputies, saying they believed they had discovered the girl, Collins said.

"Obviously we appreciate the effort of the volunteers," he said. "This shows the volunteers are a very vital part of the overall process. They can cover much more area than we can."

Jeff Dusek, the lead prosecutor in the case against David Westerfield, the man accused of kidnapping and murdering Danielle, went to the scene. The primary police homicide unit investigating Danielle's disappearance had been in the desert during the day but traveled to the discovery area.

Authorities closed Dehesa Road for a time, diverting traffic at Willow Glen and Harbison Canyon roads.

Capt. Ron Newman, head of the San Diego police homicide unit, visited Danielle's parents, Brenda and Damon van Dam, at their home in Sabre Springs. Later, a priest visited. The parents made no immediate statements.

San Diego Police Chief David Bejarano described the body found as that of a 3- to 4-foot white female with blond hair visible from the back, wearing a plastic necklace similar to that seen in photos of Danielle. One earring was visible, which appeared to be the same type of earring Danielle was reported to be wearing the night of Feb. 1 when she disappeared.

Bejarano, speaking at a downtown news conference Wednesday night, said it likely would be at least 24 hours before a positive identification was made using dental records, and if that wasn't possible an identification using DNA would take three to four days.

No weapons that might have been used in the victim's death were apparent at the scene, Bejarano said.

District Attorney Paul Pfingst, who joined Bejarano at the news conference, said the investigators' preliminary assessment was that the victim had been killed elsewhere and the body dumped at the site.

DAVID HARDMAN / Union-Tribune
Parts of the body were in an advanced state of decomposition, Pfingst said, and earlier reports that the body may have been partly burned likely were in error.

Discovery of what likely is Danielle's body changes the nature of the case against Westerfield, Pfingst said.

"The body is the most fertile source of clues," he said.

The district attorney said the investigation at the scene would take time.

"At this point speed is not an issue," Pfingst said. "We'd rather do it right than do it fast."

Westerfield, 50, a neighbor of the van Dams, pleaded not guilty Tuesday to charges of murder, kidnap and possession of child pornography in connection with Danielle's disappearance. A judge Wednesday morning ordered the search warrants in the case unsealed.

Westerfield, a self-employed engineer, was arrested Friday outside his attorney's office after weeks of being labeled a potential suspect in the case by police. He is being held in the county jail downtown without bond.

We don't want to think that LE would want to harm the case before trial by spreading info about the case, but it happens. Much like we don't want to think or believe that these upper middle class parents could indirectly have been a player in their daughter's disappearance by their alleged actions that night.

Exactly !!!!

Let me just say that my son-in-law is LE in a city of San Diego County and he has a number of friends who are LE in various cities throughout SD County. He told me about the "swinging" the second or third day of Danielle's disappearance. It was some time before I heard about Roberts' story. Son-in-law didn't say this is absolute fact, but he did indicate that a fellow LE in the area had told him about it. So FWIW.........Roberts is likely telling the truth about his source.

This post is the closest thing to a secondary source I've seen yet. With the same problem as before, it comes from an internet chat room or forum where anyone can represent themselves to be anything and claim anything.

My 1st point is, very nasty posts have been made repeatedly on many VD threads based on what amounts to internet urban legends with absolutely no verification of any kind. Rumors have repeatedly been asserted as fact.

2nd point is, I have no doubt that LE looked into the "events" of that night very thoroughly, and they moved on, in a different direction. LE has pursued, investigated and arrested a neighbor, not alleged participants in VD alleged "lifestyle". That to me, speaks volumes about the validity and irrelevance of the "swing" angle.

If this is your backhanded way of calling me a liar, it is pointless to talk to you. People here that have known me much longer than you, can vouch for the fact that one son-in-law is a police officer and the other is a Marine.

Topics related to both fields seem to come up often on FR and this is not my first discussion that references it.

I don't care what you believe, but why on earth would I make it up? I made it very clear that he didn't tell me it was a hard, cold fact; just what he had heard.

So please do not address me any further. Once you accuse me of not being truthful, you are unworthy of further conversation with me and I will no longer respond to you.

On yesterday's news I heard it was one of the Van Dam's that found the body.

I have been reading the reparte on this and other threads and have come to some conclusions.

I believe the "lifestyle comments", have hit a nerve with some on FR. It seems that those who attack folks with a negative feeling for the parents are also those who defend other alternative lifestyles as free speech, for the most part.

Your response to this has been lucid and clear. I appreciate your tone and your well thought out argument. As for myself, I continue to wait for LE to finish their work. I also continue to have little or no respect for the parents in this matter and will continue to make my feeling known, regardless of personal attacks.

I'm glad to see this. This tells me the police and the DA are still taking this very seriously, and are doing their best to gather all the evidence they can gather. I don't want to see any mistakes that may allow the guilty party to walk or make a plea bargain. I want to see this one taken to the limit. No need to hurry. Doing it right is more important than doing it quick.

I had heard that it was a VD volunteer searcher. I had not heard it was a VD. Do you have a source? There has been much confusion when the body was found.

When Pierce, from the Millinium Children's Fund, came over, Damon refused to pray with him. Hmmmmmm....

So what? I'd refuse to pray with him, too. I'm a agnostic. Does this make ME a suspect too? Hmmmmmm.....?

Thank you and I agree completely with your statement above.

I suppose that some of us are unable to completely separate the "reported" lifestyle with the event. There just seems to be such fertile ground for a connection.

IF RUMORS ARE TRUE, my opinion of the parents and that to which their children are exposed would be no different if no crime had occurred at all.

The fact that both victim's family and perp may be sexually deviant ignites a spark of suspicion in a lot of people. It seems like a natural reaction.

"Secondary source" does NOT mean "liar". It merely means "in addition to the primary (first) source".

This is the "liar" insinuation. You seem to have a habit of reading only the parts you want to see.

I suppose that might explain your agnosticism too. You choose not to see the hand of God in this world. I'm sorry for you. I imagine it's not a comfortable place to be.

IMHO, no real grief showing. They also have a barely perceptable "got through that one OK" grimace. There just is a LOOK about them that doesn't feel right.

Living near a large city (Philly) we get our share of "missing children" who later turn out to be homicides by the people who report them missing.

It's not easy, but you usually can tell the genuine from the fakes on the tv interviews..the fakes are just a little too grief stricken (crocodile tears), or tell the story a little bit too enhanced. Mrsgwmoore and I usually look at each other and say "Freezer" at the same time, as that seems to be a common place for Philly child homicides to be found. I realize this sounds sick, but since Mrsgwmoore works in the Judicial system, this is kind of the way it is. Humor is a powerful defense mechanism.

Keep the Faith for Freedom

MAY GOD BLESS AND PROTECT THIS HONORABLE REPUBLIC FROM THE CLEAR AND PRESENT DANGER EXISTING TODAY BOTH WITHIN, AND OUTSIDE HER BORDERS.

I agree with sneakypete - this thread is absolutely SICK! Freepers are at their worse! Sorry. There is no proof other than some gossip monger that is pointing his finger at the parents. And because of this gossiper, Freepers are assuming the worse of these parents. This absolutely sickens me. This is Freepers at their worse! Today a Freeper is implying that the Father sexually abused his daughter! This is SICK POSTING in my humble opinion! And anyone observing this web site would see this!

Every post made here is in the public domain and reflects on all of us - I think this persecution of the parents is over the edge!

Well, I guess one person's persecution is another's reasonable inquiry.....eyes wide open....or eyes half closed. Matter of choice, I suppose.

**********you have no idea what these parents are going thru**********

This statement is so true. My son was killed in an accident & afterwards I was zombe. I was in shock for several months & any crying I did, I did in private. I kept my composure when others were around. It wasn't difficult because I felt like I was frozen.

I have been around FR for several years & its always the same with every tragedy. I hear people say "she didn't cry enough" or "he didn't act like I would have acted in the same situation".

You have no idea how you would act in public if this happened to you.
