I withdraw my question and rephrase it thusly.

With a home proposed deportee could go to, what would be the problem with giving said proposed deportee the choice of working out his immigration problems out of custody at his chateau, or waiting his hearing here in custody?

We can fence all we want, but the point is that not ALL those who violate their visa are flight risks. Typically, those who be those with property, or higher income white collar jobs in the US. I appreciate that the rule of law and due process is sometimes inconvenient.
