Bad News for Mary Frances Berry

Readers have been begging for an update about the refusal of Mary Frances Berry, the infamously partisan Democrat who runs the so-called U.S. Commission on Civil Rights with an iron fist, to seat Bush appointee Peter Kirsanow. So here's the latest.

The Democrat-dominated panel's action probably won't withstand a court challenge, congressional researchers have now said.

The whole mess started when Bill Clinton named Victoria Wilson to complete the term of the late Judge A. Leon Higginbotham Jr. Even Slick Willie himself "noted in the appointment certificate that Wilson's term would expire when Higginbotham's would have, on Nov. 29, 2001," the Associated Press reported today.

However, the fanatical Al Gore supporter Berry apparently cares little for the civil rights of non-Democrats. She decreed that Wilson would illegally stay on the commission for six years, and the partisan panel refused to seat Kirsanow at its meeting Dec. 7.

"In a Dec. 14 memo to the House subcommittee on the Constitution, the Congressional Research Service said the civil rights panel's maneuver runs counter to Congress' intent when it reauthorized the commission in 1994. It said Congress meant for commission members to serve staggered terms so that no one president can stack the panel with appointees," AP reported today.

Allowing Wilson to remain for six years would mean her term "would expire closer to, and perhaps coincide with, the set of four other expirations," said the memo, obtained today by AP.

The memo concluded that a reviewing court would likely find "that Mr. Kirsanow is entitled to the vacant position on the commission."

Firing her for cause and physically removing her would lead to a media circus that would benefit the democrats by stirring up black racial paranoia. Proceeding by court action so that in the end republicans have nothing to do with her removal makes sense. Meanwhile she continues to defy the law and damages democrats with the crucial swing voter. And the commission has no actual power anyway. Her antics tend to discredit the whole idea of the civil rights movement by making it look like nothing more than a partisan spoils process. This is invaluable.

Good analysis, however, the Clymers are silent on her antics. Only were she to be really challenged would the lamestream presstitutes deign to report--and for the very reasons you state. Hopefully, this being a simple question of law, a judge will issue an order forthwith...

Actually, it would be fabulous to see J.C. Watts take the lead on getting this chick canned. After all, it's a "black-on-black issue" between Kirsanow and Berry just as much as the "black-on-white" Bush v. Berry that liberals so dearly love.

So even though we stand behind black conservatives, maybe they would be best in the fore on this.

The most important question is when will MFB's term be up.

"Mary Frances Berry became Chairperson of the U.S. Commission on Civil Rights on November 19, 1993. An Independent, she was reappointed to the Commission in February 1993 by the Speaker of the House to serve a six-year term."

From this, I assume, Clinton appointed her to another 6 year term in February 1999. If I'm not mistaken, her term will end in February 2005, right after President Bush is re-elected. I don't see how he could fire her early, not without Jesse Jackson, Al Sharpton, Maxine Waters, and Hillary starting a race war, so 2005 it is. Reason enough for republicans of all stripes to get out the vote for President Bush's re-election in 2004.

That is done by democrats in every election. The Republicans will fare better when they learn that they aren't going to get the black vote by catering to them. Any black votes for Republicans are cast by those who believe in the postion of the party on issues. That should be the end of it.

Ann Richards warned them, but they still haven't figured out that GWB can play them like fools.

Marry Berry is going to get one of her outrageous tirades shown on FoxNews one day, and then Geraldo is going to chide the other networks for trying to protect her.

After that, the judges are going to overrule her and she's going to lose not only multiple battles, but also the war. In the end, she'll blame racism and never even realize that she was outsmarted from day number one.

I mean really. Was that a recount that just went our way? Was that the ABA that just got booted from "reviewing" federal judges for Congress? Was that the largest Dollar value tax cut in world history that just got passed? Was that CO2 regulations that just got cancelled? Was that OSHA home office regulations that just got repealed? Was that an Education bill that just got passed? Was that National Missile Defense that just got funded? Was that the ABM treaty that just got killed? Was that a "quagmire" in Afghanistan that just got blitzkrieged? Was that Campaign Finance Reform that just got shelved? Was that Al Gore who decided to go work in California for private industry rather than re-enter politics?

And still the Democrats can't catch on...

Get a US marshal to throw her a$$ out in the street and let her sue to get back on the commission. Let her pay the legal bills. Why be so damned passive?

I think you're giving the infamous "swing voter" credit for being far better informed than is the case. It is easy for those of us who spend hours at a time in front of the computer on FR and watching Fox news, with a little Rush thrown in for variety to take for granted that others are as familiar with these people and their politics as we are. In my opinion the vast majority of Americans still get most of their news in pablum form as peddled by the likes of CNN, if indeed they even get that much. Some are still restricted to local news, and even with that many don't bother to watch. Truth is, for many of these people, if there is not a BIG SHOW they are unaware anything is happening at all.

Interestly enough President Reagan did remove her in 1983 along with two other commissioners, she filed suit and won. She claimed President Reagan said she served at his pleasure and she wasn't giving him much pleasure.

That "commission" is nothing but a freak show in a broken down, travelling carnival.

I, for one, am willing to let Berry stay on as the blow-off for as long as she wants to gibber and scamper around the stage.

Bush should simply ignore her, her rantings, and her agenda, and work behind the scenes to cut off funding instead.

If she has committed a criminal act, which seems likely, just arrest her at lunch one day, handcuff her, and let the media film her wearing her orange prisoner jump suit at her perp walk.

Ashcroft has already told her that she cannot hire an attorney to represent herself OR the commission. We're NOT paying for it.

Actually, there is a question about her "due date." Clinton evidently didn't get the paperwork over to whoever it was suppose to go to and her appointment is suppose to be over way before Bush begins his second term.
