Stanley Released from Jail; Charged with Violating an Unconstitutional Gun-Control Ordinance

(DENVER, CO) Libertarian candidate for U.S. Senate, Rick Stanley, was released from Denver Police custody on Sunday, December 16, 2001, at approximately 3:30 PM, after being charged with violating a local gun-control ordinance. Stanley contends the law he is charged under violates his civil rights and he will be seeking a jury trial to have the ordinance declared unconstitutional. Second Amendment supporter Duncan Philp was also arrested and faces an identical charge.

Stanley and Philp were arrested by the Denver Police, Saturday, December 15, 2001, shortly after noon, upon performing a planned act of civil disobedience by openly carrying a loaded handgun in a holster upon their hip, during a Bill of Rights rally being held in Denver's Lincoln Park. Both Stanley and Philp, stated their actions were an attempt to exercise their constitutionally guaranteed rights under the Second Amendment of the U.S. Constitution and Article II Section 13 of the Colorado Constitution. They are now facing one count each of unlawfully carrying a deadly weapon in violation of Denver's Revised Municipal Code, 38-117.5(b).

Paul Grant, a civil rights attorney who will be representing both men is optimistic about their chances in court. On Saturday Grant stated, "There's absolutely no way a judge should be able to uphold Denver's ordinance in light of the state constitution". Public support and attention would be an essential part of the case, said Grant who has argued cases on several different occasions before the Supreme Court. He urged all supporters to attend these men's court dates and to speak out publicly on this issue explaining that; "Jurors must realize how important this case is".

Mr. Stanley's next court date is Wednesday, January 30, 2002, 8:30 AM, Courtroom 151P, in the County Courts Building located at 1437 Bannock Street in Denver. Supporters are requested to pack the courtroom that morning.

Hey I will be generous and give Mr. Stanley 5% of the vote. What did you accomplish other than a feel good vote, while Daschle smirks from his Senate Majority leader's office.

wow, what a sad and sorry state of affairs, when someone argues that one must vote for a person because of the letter next to his name, and not personal merit.

your arguement smacks of "shut up and get back in line, or *gasp* we'll lose the majority!"

Is it especially funny when those RINOs help make up a liberal majority, but dane's dreams will be pleasent as long as we pay lip service to rights and freedom and have more (R)s than (D)s...

Even if those (R)s act more like (D)s.

I, for one, am thoroughly sick of having the big wheels of the two(ha!)parties crushing the advance of anyone else! Let the people decide! Open up the debates and let US chose, coronaries or no! They say (and I have as well) it begins at the local level. But even there, the non-partisan voting set up makes any real headway almost, if not definitely, impossible.

I don't get it. Either the Libertarian Party is a weak party with no effect on politics, or they're the reason why Republicans lose elections. I wish they'd pick one and stick with it.

Gee, I don't get it either. Most people understand that there is a reason one loses elections. And it's not cause the other candidate is a Libertarian - it's cause they are a rotten candidate. If they were doing they're job they wouldn't have anything to worry about.

But, as we have seen for decades now, the Republicans and Democrats are doing a really crappy job. The Constitution and the Bill of Rights are in tatters, but I guess we should just keep voting for the same traitors we always have, huh?

Don't come looking for me when the Republicans approve the gun confiscation bill that's coming sooner or later... People like you who are blinded by the facts that your party has sold you out, are the reason we are in this mess in the first place.

Didn't you notice when Ashcroft said that defending the constitution only helps terrorists? How is our government supposed to function with a nut like this Attorney General? And Bush is the one who wanted him in there? How do you explain that?

Wake up! Our country is going to hell in a hand basket, and Republicans AND Democrats are equally responsible. (As you can see by the 50-50 division). Without our Constitution and Bill of Rights we are but slaves. Your beloved Republicans are doing nothing to stop this from happening.

Vote Libertarian - for REAL AMERICANS WHO VALUE FREEDOM and a CONSTITUTIONAL GOVERNMENT!

If Libertarians are so small and insignificant, why do you devote so much of your time opposing Libertarians?

Have you ever considered that your life is being spent on something that you insist is small and insignificant? That pretty much makes your life's work small and insignificant.

Nonsense. The whole point is to get convicted. Otherwise, there's nothing to appeal. I don't normally say this, but--man--you sure are stoopid.

please, spare me. every day you set new standards for stupidity on this forum, and every day more and more people call you on that stupidity.

do you know nothing about the trial-by-jury system? maybe you should read up on why Thomas Jefferson thought it is the final check and balance in our 3 part system of checks and balances. the elites can write the laws, the elites can sign the laws, and the elites can "declare" them Constitutional, but if it doesn't pass the public smell test, then it's no good. that's what's so great about trial by jury. I would hate for you to have to be in a situation of a jury trial where you need 12 of your peers to say that the man you killed breaking into your house was in self defense, so that you would not get convicted of some charge like manslaughter.

I, unlike you, would not care if a card carrying member of the Communist Party USA got arrested to help protect MY right to keep and bear arms. this man has done more to protect that right that YOU BOTH enjoy than ANYONE you've voted for in the past 15 years, I'd wager.

you make it abundantly clear, day by day and post by post, that you are no friend of Freedom, Liberty, the Constitution, or States Rights. you consistantly, and somewhat succesfully, shirk and shunt any meaningful debate.

you, like so many others here, have nothing of any real substance or value to add to any discussions that take place; instead trolling for any thread containing the word "libertarian" or any thread where people espouse ideals of individual Liberty and Freedom, baiting them and engaging in petty flame wars.

I am very pro-second amendment, but I don't think the "in your face" antics as being demonstrated here are going to help.

Like it or not these type of antics turn off more voters, than turn them on. And it is easy for the press to paint this guy as a gun nut.

But hey you all are on a "crusade" and you are "right" and everybody else is a Fascist.

You catch more flies with honey than vineger.

That's good coming from someone blind enough to think there is a difference in the two "major" parties.

The "difference" you claim is really nothing but a falling out amongst thieves, quarreling over their stolen loot. They both believe in robbery. For our own good of course.

A 1% margin in the Colorado Senate race can give the demo the win and keep Dashcle as Senate Majority leader. If you think that is insignificant, that's your problem.
