Stanley Released from Jail; Charged with Violating an Unconstitutional Gun-Control Ordinance
(DENVER, CO) Libertarian candidate for U.S. Senate, Rick Stanley, was released from Denver Police custody on Sunday, December 16, 2001, at approximately 3:30 PM, after being charged with violating a local gun-control ordinance. Stanley contends the law he is charged under violates his civil rights and he will be seeking a jury trial to have the ordinance declared unconstitutional. Second Amendment supporter Duncan Philp was also arrested and faces an identical charge.
Stanley and Philp were arrested by the Denver Police, Saturday, December 15, 2001, shortly after noon, upon performing a planned act of civil disobedience by openly carrying a loaded handgun in a holster upon their hip, during a Bill of Rights rally being held in Denver's Lincoln Park. Both Stanley and Philp, stated their actions were an attempt to exercise their constitutionally guaranteed rights under the Second Amendment of the U.S. Constitution and Article II Section 13 of the Colorado Constitution. They are now facing one count each of unlawfully carrying a deadly weapon in violation of Denver's Revised Municipal Code, 38-117.5(b).
Paul Grant, a civil rights attorney who will be representing both men is optimistic about their chances in court. On Saturday Grant stated, "There's absolutely no way a judge should be able to uphold Denver's ordinance in light of the state constitution". Public support and attention would be an essential part of the case, said Grant who has argued cases on several different occasions before the Supreme Court. He urged all supporters to attend these men's court dates and to speak out publicly on this issue explaining that; "Jurors must realize how important this case is".
Mr. Stanley's next court date is Wednesday, January 30, 2002, 8:30 AM, Courtroom 151P, in the County Courts Building located at 1437 Bannock Street in Denver. Supporters are requested to pack the courtroom that morning.

SHUT THE H#ll UP!
Damn am I tired of your B.ravo S.eirra. Forget political parties. Forget your goddamn cheerleading for a second.
Do you support the Second Amendment, as defined in the writings of the Founding Fathers, or not?
If you never answer another one of my questions with a straight answer, at least answer that one. Yes, or No.
Despite your condescending manner you have a point. It is true that the libertarians have not been tested.
But the Republicans have been tested. And they failed.
I ask again: if the GOP gets control of the Senate and keeps the House, will they do something about this? Or just hide behind the usual circle-jerk logic: "we can't do anything 'cuz then we couldn't get elected...we have to be elected so we can do something...but we can't because...etc etc."
I agree with you here. I find this line of thinking very frustrating. And you're right, it is their approach. Not since Newt Gingrich in 1994 have we seen politicians willing to take a risk. He did and he was stabbed in the back by the GOP and the losertarians.
Compare track records...
Democrats and republicans are responsible for over 20,000 violations against the Constitution and the right to keep and bear arms.
Democrats and republicans say this: "the government can't be trusted, The People even have a 4th Amendment to protect themselves from us, but The People must trust total strangers and open their doors to them." Think discrimination laws.
Republicans and democrats expanded the national debt to over five-trillion dollars.
Democrats and republicans have committed by far the greatest number of violations against The People, the Constitution and the Bill of Rights.
Well, Well, Mr. Pagan you should yell,
Shut the Heaven up
I think among your religion that would be the insult.
Why would that trouble them unless they had a vested interest in initiating force? But they will never openly admit that anymore than Clinton would admit to having sex with Monica Lewinski and Jennifer Flowers.
He was indeed stabbed in the back by the GOP. But since libertarians are not Republicans (and as you yourself pointed out have no power in govt) I do not see how they could have stabbed him, or that he would even notice anyway.
I gather then you agree the GOP will do nothing for gun owners, even if the GOP wins. So, I should support them...why?
And don't forget the media. In 1994 the media still had a grip as the information gatekeepers and they skewered Gingrich.
The media is whom I see as the biggest "enemy", the Libertarians, IMHO, are impatient, misguided, and naive blowhards who really don't do that much damage except in close races where they help elect the democrat.
Then why hate yourself?
So "freedom" and "duty" are mutually exclusive?? You are weaker than the weakest link!
Sheesh, that is roundabout way of describing your orgasm over a Tom Dashcle led Senate.
I noticed you still failed to answer my direct question to you.
Kinda gives a LOT of credence to those who have labeled you a shill and a disruptor.
If the powers were delegated by the people directly, then we would be the government and it would be huge. THere would not be a clear separation of powers that would be competing.
Impatient you say? The GOP has been moving in the wrong direction for my entire lifetime. What exactly are they waiting for? If they gain the Senate in 2002 and keep the House, they'll have it all. What will your excuse be then?
I agree with you Dane. Perhaps I give them too much credit. Most of the time they're as harmless as zoo monkeys flinging their dung against the cage walls. Once in a while one escapes and causes some hearburn at the banana factory.
