$1,000,000 Million Judgement against Jim/FR LLC - What does it mean?
12-02-01 | Bob J

Posted on 12/02/2001 10:09:56 PM PST by Bob J

Nothing...thats what it means.

The afholes have been trying to scare FReepers with this little bit information. Here is my opinion on the subject.

As you all know, the Washington Post and LA Times sued FR LLC and Jim to stop it from posting full text articles. The basis of FR's attorneys defense rested on the fair use clause. Unfortunately, Jim drew probably the worst judge he could...Margaret Morrow, a Clinton nominee, whose appointment was held up for a long time by Republicans due to here obvious left wing opinions.

The plaintiffs attorneys filed a pre trial motion to squelch the fair use defense and Judge Morrow ruled affirmatively. That basically took all the guts out of the Jim's defense. At that point, Jim's most prudent course of action was to stipulate to a decision against him. That way the case could get into the appeal with the least cost. This may have actually worked for the best since if Jim won, the WP was certainly going to appeal. It would also follow that whoever lost the appeal would then appeal to the SC. It has been estimated going directly to appeal may have saved Jim and FR 200-300k. Now, it may only cost 20-30k to get all the way to the Supremes.

Once Jim stipulated, they were allowed to ask for a dollar judgement. When Jim found out it was 1 million, he said "Why not make it 500 million. Hell, make it a billion!" The fact is Jim nor FR LLC have any money. What is raised during the quarterly FReepathons is used during the next 3 months for expenses. The LAT and WP know this. I doubt if they expect to ever see a dime of it. The judgement allows them to put a nice round number on their balance sheet to offset the obvious huge expenses this case is chewing up on their P&L's. Can you imagine the public relations nightmare for a multi billion dollar corporation to going after a disabled vet for a million bucks he doesn't have? How about a billion...heheh.

Obviously, some donations go to legal expenses, as in any business, but Jim is trying to minimize the cost. So, when an afhole throws that million dollar judgement in your face, as if you are or they expect you to pay for it, say what Jim said, "Thank you sir, make it a billion, please!"

Ha! What loosers...

Having no knowledge of how FreeRepublic is structured, one thought would be to file a Chapter XI, and tell the rats to pound sand up their clintons.

Let the rats eat at nothing.

If you've got million dollar judgement and no assets, it certainly looks like an option.

Don't you know that this means that the FreeRepublic now exists because the liberal LA Times and Washington Post have extended Jim charity. You are WELFARE RECIPIENTS. This is the greatest victory that they can ever have hoped for- all of you having to rely upon their charity to allow this page to carry on.

Clinton atleast had the dignity to graciously ask for help from his friends, and then he paid his bills. JR cowardly hopes that the liberals will take pity on a pathetic cripple (not a vet- he only served during wart time, not in war). Pathetic is the word.

As you know, one lady had her daughter check the site out because she was afraid the board might turn on her if she did not give.

Please provide a link for same.

Fair enough, however, I find most of what they write to be ridiculous and possibly defamatory and a little just plain looney and obsessive. What is it about what they say that you find alarming?

I am amazed that they would put forth so much energy into this. I know that most of them are conservatives that in some way feel that this site has betrayed them and their ideals. I think most of them felt they had invested energy here and were somehow misled. I think most people would simply fret a bit and then move on, for some reason these folks are on a mision. Regardless of their motives, they bring up a lot of points that should be free and out in the open here on FR.

Do you think they (afwaa) have ever been over to Democratic Underground soliciting members?

I do not think that they are looking to recruit FR enemies from within the liberal ranks. I think they feel it is their mission to inform the conservative ranks about their experience and feelings about FR.

BTW - Which afwaa member do you like the best?

Come on! I am not going to answer that. I kind of view them as a totality - kind of borg like. Just kidding

Excellent argument(s)...logic addressed the frantic emotion, and who wouldn't be frantic to see their dream being destroyed by pesky old laws.

Bottom line...copyright material is personal property, FR has NO RIGHT to others' property. This should have been addressed LONG ago, while time and money was on FR's side.

All that is left in this legal FIGHT is anger, disappointment, dashed hopes, bills, and bad feelings for OLD Freepers.

IN the end...the BIG BOYS with the BIG BUCKS will win...they have time and lots and lots of money on their side...they will, in the end, win.

God Bless the Robinson's, I hate seeing their great idea destroyed, and I hate to see all of this implode daily in these types of threads.

Regardless of their motives, they bring up a lot of points that should be free and out in the open here on FR.

They have never shown the maturity or courtesy to keep it clean and honest. Not one of them has a legitimate gripe so they make up the cause of their self-righteous indignation.

I know you know this, and you know I know you are being exceptionally disingenuous, but JR took a look at what the pirates and the trolls were doing to the anti-freepers and first implored us to take it elsewhere.

Mojo insisted on coming out of the box at Yahoo with lies about Clarity and Talk-Spot. Clarity backed him down in one message and the rage has intensified. Mojo's allegations about Talk-Spot are absolute rubbish and when he finally comes before the bar, he'll need one of those tin-foil hats he claims all the whackjobs here wear.

Their allegations are bullshit. You're on the edge.

Maybe you should tell folks what your relationship to Mojo is all about. Start with NYC.

I mean A for effort and all, but a D minus for the overall transparency. Better luck next time.

It didn't seem transparent to me.

If that was an imposter (was Mojo also X, Y, and Z?) he/she brought it off.

Taken at it's face value (#2820), it should be required reading for anyone who cares about FR.

I care about FR.

Taken as merely a very good post, it should be required reading for everybody.

"I thought that sort of sophomoric behavior exited with Brian Buckley's departure...apparently not..."

Relax, Joe.............this isn't a court of law. Besides, some (obviously including you) may disagree with Brian's tactics, but I believe he acted in FR's best interests. I'll answer that next thought that just popped into your head: no, I'm not hopelessly naive. Far from it. Either way, God bless.........hope you've been well.

Here is the quote from a LONG post (#2820) in Is Free Republic a Fraud? Is it time for Free Republic to go away?:
"...How many people have access to the donation information. (This is a big issue for my Mom because she tells me she has been on threads where people have made statements to a poster that seem to indicate that they have sure knowledge as to whether or not another poster gives money and how much. Mom says it's getting common for some to 'dis' a person with whom they may disagree in that manner (I've seen this here, on this thread, as well) and although she has been a very generous, semi regular supporter for two years, she sees the day when she won't be able to do so anymore and is worried people "will turn on me" ... her words...." - A_dutiful_daughter

(bold added by me.)

(BTW, in case you missed my earlier posts, I do not care WHAT Jim does with any money that I give. I love this place!)

Gettin' pretty desperate there, Bob. Everybody over there that I know of used to post here. Good conservatives all, albeit not of the Bircher persuasion so prevalent here.

Most of them left in the May '99 purge. You remember that don't you? When JimRob showed all the Bush supporters the door?

Me, I pretty much left when Connie and Brian rose to power. I'm a pretty perceptive guy, huh?

"Yes, even though I've often considered Free Republic useless as far as real truth is concerned,..."

You lost me.........and every other person on this Forum with a brain...........right here.

Who in God's name set you up as the ultimate arbiter of "real truth"?

Get over yourself and save your missives; you just emptied your keyboard of "credibility".
