The Justice Department asked an appeals court Thursday to intervene in its lawsuit seeking to temporarily block California from counting more than 20,000 mail-in ballots from voters the Trump administration says are likely not U.S. citizens.
The Justice Department asked the 9th U.S. Circuit Court of Appeals to get involved before a lower-court judge ruled in the dispute.
Justice Department lawyers said the unusual maneuver was necessary because the judge assigned to the case, U.S. District Judge David Carter, had not made a decision by Thursday afternoon, as the department had requested.
Carter scheduled a hearing for next week to consider the department’s request for an emergency order to block California from counting mail-in ballots from more than 20,000 voters in the Nov. 3 midterm elections until their citizenship status could be verified. The department said it interpreted Carter’s lack of ruling as a “constructive denial” of its request.

Can DOJ ask for extra verification to ensure that 20,000 identified non-citizens don't illegally vote? A serious panel of Judges Bennett (Trump), Bumatay (Trump), and Sung (Biden) have set a super expedited schedule. Oral argument on Sunday?
The 9th Circuit will hear remote oral argument via Zoom tomorrow at 1 PM Pacific in USA vs. State of CA, the case regarding mail ballots sent to 20k "likely noncitizens." Arguments will last 1 hr - 30 minutes for each side.
No standing. Get lost.

California to the Ninth Circuit:
“Because we have already begun tabulating mail in ballots and there might be illegal ballots among those already cast that we can’t segregate, we are obligated to finish this election out by continuing to count illegal ballots for consistency.”
“A Sunday Surprise at the 9th Circuit Could (Pleasantly) Change DOJ’s California Election Fight”
“There have been some interesting developments in the ongoing saga related to vote-by-mail ballots sent to approximately 20,000 “likely noncitizens” in California, and the Trump DOJ’s efforts to have those ballots segregated and not processed if/when they’re returned until citizenship can be verified.
As I reported late Friday night, after the DOJ appealed District Court Judge David Carter’s “constructive denial” of its emergency motion to force California officials to segregate ballots returned from people on the “likely noncitizen” list to the 9th Circuit Court of Appeals and filed the same type of emergency motion there, the 9th Circuit ordered the State of California and LA County to respond by noon Pacific time Saturday. Those parties did so, and LA County Registrar Dean Logan also filed a Motion to Dismiss the appeal for lack of jurisdiction.”
That would be an insane response by CA lol..as it usually takes them a few weeks until AFTER the election to count all the mail in ballots..
California’s voting system needs to be scrapped and started over from scratch. It’s a national joke and that is not the way any state’s election standards should be considered.
