That leads us to Illinois Democratic Rep. Delia Ramirez. The circumstances of her birth are an example as to how this ruling is going to turn out when looking to the next generation of public officials.

In an article on Ramirez from January 2023, CNN noted her mother crossed the Rio Grande River when she was pregnant. Ramirez would be born into a family of Guatemalan immigrants on June 2, 1983, in Chicago, Illinois. In other words, her mother was an illegal alien and had a baby here that became a citizen anyway.

Now serving in Congress, you would imagine Ramirez would take every opportunity to express her patriotism, putting America first, but it’s just the opposite.

Democrat Rep. Delia Ramirez at a summit in Mexico City this weekend tells the audience while speaking in Spanish: “I’m a proud Guatemalan before I’m an American.”

The House of Representatives should expel this woman. Her husband is also an illegal alien who describes himself as "DACA" beneficiary.

It might be possible to get this passed. Pandering Democrats have been taught in New York and Colorado that pandering isn’t enough anymore:

POSSIBLE AMENDMENT

Only persons who had a parent with United States citizenship nine months prior to their birth may be a member of Congress or possess federal judicial power effective after the first January 2nd of the first even numbered year after ratification.

The terms of the House of Representatives shall be for four years starting with the first even numbered Congress after ratification.

The Supreme Court of the United States shall not have more than nine members in any October to September period.

Many babies of PRC moms never reside in any state. Mere popping out in the USA is insufficient.

The “and” is important. It means that the clause is merely retroactive as of the date of ratification.

born - past tense

naturalized - past tense

are - present (time of ratification [1868]) tense

Shall is normally used in the Constitution for the future tense.

Amendment X uses “are reserved”.

Reserve means “to keep back or save for future or special use”

The citizenship clause is at most a one-time (1868) grant.

The fact that the writers didn’t use the oft used Constitutional word “shall” matters. It was the obvious choice. It also would have accomplished what they undoubtedly intended.

Also consider the citizenship of babies born in the USA with parents having citizenship from the country of India.

The babies can get Indian citizenship upon application, but they are not born with it.

Why does India have such a system? Probably so that babies of citizens of India don’t run afoul of the complete jurisdiction requirement.

“If birth in the US alone would constitute US citizenship (particularly following Wong Kim Ark of 1898), then there would have been no need for the Indian Citizenship Act (Snyder Act) of 1924.”

It would be silly to say that a baby of Mexican Apaches if popped out in hospital room in El Paso would be an American citizen under Amendment XIV but a baby of American Apaches if popped out in the adjoining hospital room would not.

Relying on that is very dubious since the US government pays hospitals for most anchor baby births.

Exactly, it’s like they stop at “United States” and continue to “are citizens”. This John Roberts really really ticks me off, why GW nominated that jackass is beyond me.

Kavanaugh actually suggested, that Congress implemented current practices, so congress can change them.
That seems to me the proper way.
Mere executive order in this situation may indeed be not sufficient, the same way as DACE order was not either. but an act of congress should be!
