It’s a 6-3 Supreme Court: Ideological splits mount ahead of major end-of-term rulings

The Supreme Court hit an inauspicious milestone Tuesday as it raced to finish its most divisive pending cases by the end of the month: It has already handed down more 6-3 decisions along ideological lines than it did for the entire term that ended last year.

As it navigates a charged political atmosphere during President Donald Trump’s second term and endures sharp criticism from the left and right, the court has already split into conservative and liberal camps in seven decisions this year — one more than last year — before it even gets to major cases on presidential power and transgender rights.

Some of those decisions, including on whether Trump may fire officials at independent federal agencies like the Federal Trade Commission, may also divide the court along ideological lines. The justices are scheduled to drop their next batch of opinions on Thursday.

Four of the five decisions the court released Tuesday were 6-3. Those included a ruling that barred a Rastafarian man from suing prison officials who violated a federal law when they cut his dreadlocks and a decision that permitted Exxon to sue over property confiscated by the Cuban government in 1960.

The most significant 6-3 decision so far this term was the court’s April ruling that gutted the Voting Rights Act’s power over redistricting disputes. The decision, and several that followed from it, helped Republicans quickly redraw congressional district in Southern states like Louisiana and Alabama to give the GOP an advantage in this year’s midterm elections.

And those numbers do not take into account rulings on the court’s emergency docket, where the liberal and conservative wings have split more frequently.

28 Unanimous Decisions
10 8-1 Decisions (one 8-0 as Alito recused on a case)
3 7-2 Decisions
10 6-3 Decisions
3 5-4 Decisions

Actually the 5-4 split is not the norm. But 28 decisions have been unanimous. Notice the article forgot to mention that the court is far more united than it is divided.

Gotta love that CNN spin. You don't hear about ideological splits when the decisions went 6-3 in the liberal direction. No, in those cases, it was the law of the land, period. Screw you, CNN. 6-3 means that its the law of the land. So does 5-4 no matter how much you cry about it.

Out of those ten 8-1 decisions, how many had KBJ as the lone vote on the losing side? I would guess at least 9 of them.

No one seems to track that info.

I had a spreadsheet of all of the decisons as of a week ago. Accidentaly deleted before saving. Not planning on recreating it.

The thing about Roberts is that he always sides with a conservative 5-3 majority, to make it 6-3.

He is a coward that way. It gives him cover to be seen siding with the conservative ruling when it doesn’t matter how he decides since the case is already decided by the 5 member majority. In that way, he can be the 6th member and be “seen” as a conservative.

The thing that kills us with Roberts is any time the court is split 4-4. That is usually when he is the deciding vote for the Liberal/Left ruling.

So Roberts is in a lot of 6-3 decisions for conservative rulings where his vote doesn’t really matter, and 5-4 decisions when they are Leftist rulings and his vote makes all the difference.

Roberts is far worse than Barrett.

Yes, but as Freedom_Is_Not_Free points out, Roberts is most likely to be least useful/conservative when it actually matters.

Two actual Constitutionalists;
Four slightly left leaning moderates who occasionally get things right;
Three hardcore leftists who hate the Constitution and America.

That's only because most of their cases are very non-political questions dealing with mundane, tiny-specific-detail of obscure laws. There is no us-vs-them on these, so the Commies don't have any bias in them and can just rule per law, agreeing with everyone.
