Appeals court hands Trump win in lawsuit over transgender military ban

A federal appeals court in Washington, D.C., on Tuesday cleared the way for President Donald Trump’s ban on military service by individuals who identify as transgender or have gender dysphoria, staying a lower-court order that blocked War Secretary Pete Hegseth from enforcing the policy.

The 2–1 decision by a three-judge panel of the U.S. Court of Appeals for the D.C. Circuit sharply rebuked U.S. District Judge Ana Reyes, concluding that her ruling in March overrode military judgment and applied a standard of review the courts are not entitled to use when second-guessing force-readiness decisions.

Great news! But I don’t get these court machinations. I thought the Supreme Court settled this issue earlier this year. And from what I’ve read, there are still openly “transgender” members serving.

According to linked article, all transgender military personal will be removed by June 25 unless they get a waiver.

From wikipedia:

Ana Cecilia Reyes is an Uruguayan-born American lawyer who has served as United States district judge of the United States District Court for the District of Columbia since 2023. She was nominated to the position by President Joe Biden, and is both the first Latina and the first openly LGBTQ person to serve as a district court judge in Washington, D.C

The 2–1 decision by a three-judge panel

Guess who were the members that approved openly “transgender” members serving.

Six members mum

What possible “waiver” is there for a serious mental illness?

My guess is that a waiver would come into the picture if the trans person is doing a job they can’t easily replace with a normy. The military serves at the pleasure of the president. He can say yea or nay as he pleases and for his own reasons.
