Reading the law, Trump could implement wide immigration reforms with his enumerated powers

In a late-night Truth Social post published on Thanksgiving evening, President Trump called for “reverse migration” and promised sweeping changes to U.S. immigration policy.

His message came in the wake of a tragic shooting in Washington, D.C., where a 29-year-old Afghan national allegedly gunned down two members of the National Guard. One soldier has died, and the other remains in critical condition.

In a later reported incident, Fox News published that an "Afghan national was arrested this week after posting a video of himself on TikTok indicating he was building a bomb with an intended target of the Fort Worth area in Texas," citing the Department of Homeland Security (DHS).

At the forefront of Trump’s legal toolkit is expansive authority to suspend the entry of new immigrants. Under federal law, the president can suspend the entry of aliens or impose restrictions on their entry if he determines that doing so is in the national interest.

The relevant statute states that: "Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate."

Congress seems unwilling to pass laws at this time.
The judges will say that the Chief Executive cannot use his enumerated powers.

Perhaps we’re on hold until Democrats get back into power. Then they can all go full steam ahead and no one will stop them. Because Uniparty.

It looks like the Republicans are working to intentionally lose in 2026. They are far more comfortable with the dems in the majority. That way, they can complain but aren’t required to find solutions.

Currently, I’d give fair odds that Trump will be handicapped for the remainder of his term and will only be allowed to make temporary changes (through a few executive orders). Once Trump is out, the Democrats will undo everythign he did and then absolutely ram through major changes (filibuster will be out the window). Deep, permanent transformation as soon as they get the chance, with an eye toward making sure no one like Trump can ever cause trouble again.

It will be a lot like Germany in the late 1930s. Ugly.

The people would be the only force that could stop that. And that would be very ugly indeed. I don’t think we’re voting our way out of this.

It would be much better if Congress did it - then it would be law, and would not be subject to change by future president.

This is what Congress is supposed to be doing - making the law. Instead they are doing nothing and enjoying lifetime cushy positions.

As for governing the military and the USA, either the filibuster should be made part of the Constitution, or it should be eliminated and all the legislation Trump needs to do a proper job should be enacted.

Drop a bill in the hoppers proposing a filibuster constitutional amendment be sent to the states with a six-month limit for ratification. Let’s see what the Democrats do.

When are these demagogues ever going to learn to cite the USC by Section number with a link? It saves time looking up 8 U.S.C. § 1182(10)(f).

Trump is wasting too much time on foreign policy.

Everyone thought that Bush 41 was a decisive leader after Panama and Operation Desert Storm. Then he lost in '92.

Obviously, Trump can't run again. But he will be a lame duck after the midterms especially with phony impeachment charges against him once again.

The statute in question is very clear -- I followed the link myself and read it, and the article represents it fairly. It does give the President the power to do this "by proclamation".

I agree that Congress should be doing more of this, but it is utterly gridlocked. Polarization and 60 votes to override a filibuster means it is mostly inactive. I don't have a problem with the President doing this on his own authority IF -- as in this case -- there is a statute expressly authorizing him.

I don't support this or any other President doing what they think is "necessary" based on penumbras and emanations of "inherent powers", or any crap like that, though.

In 1996 Clinton signed a bill. NO GOVERNMENT BENEFITS TO ILLEGALS. Dems just never enforced it.
