Senior citizen who saved himself from would-be mugger is heading to prison because of NYC’s ‘draconian’ laws

A Queens senior citizen who shot dead a man who tried to rob him will spend four years in prison after admitting to toting an unlicensed revolver — as his lawyer ripped the city’s “draconian” gun laws.

Charles Foehner, 67, pleaded guilty to one count of criminal weapons possession Thursday in a deal to end his case more than two years after he fatally shot would-be thief Cody Gonzalez, who charged at him near his Kew Gardens home.

The Queens District Attorney’s Office chose not to prosecute Foehner, a retired doorman, for Gonzalez’s killing after he told cops that he’d defended himself from a mugger who lunged at him late at night holding what looked like a knife — but which turned out to be a pen.

But prosecutors slapped Foehner with a slew of weapons raps for the unlicensed handgun and for an arsenal of illicit handguns, revolvers and rifles inside his home in the quiet neighborhood.

Foehner took the plea deal to avoid a trial, where he faced 25 years in prison on gun charges that are not hard to prove, said his attorney Thomas Kenniff after Thursday’s hearing in Queens Supreme Court.

Kenniff called Foehner a “hero” who was put in an “impossible position” by what he called “draconian” Big Apple gun laws that make it difficult for “law-abiding citizens” to obtain permits to carry firearms.

“If this was a state and a city that had its affairs in order, Mr. Foehner would be getting a plaque, not a prison sentence,” Kenniff told reporters on the courthouse steps.

On the bright side, he will get affordable housing and medical care. NYC should build special prisons for these type of seniors complete with Pickleball courts and hot tubs.

Just a ridiculous situation which demonstrates the idiocy of NYers. I am SO glad I moved out of NYC. I have a friend in Kew Gardens, that is scary to hear this happened there.

That city is so massively effed up. I grew up there and left - more like escaped - 15 years ago. There is not enough money in this universe to EVER make me move back to that vomitorium.

My nickname for NYC is “The a-hole capital of the world”...I could write a 2000 book encyclopedia listing all the examples that proves it, but just for starters here’s 2 names: AOC and Chuck Schumer.

Or how about this:

“Welcome to NYC, the a-hole capital of the world. The city where 3000 people were brutally murdered by radical Islamic terrorists, and what does NYC do? They elect a supporter of radical Islamic terror as Mayor”

I hear ya. But not sure what good it would have done in this instance. Remember, the Queens DA elected NOT to prosecute at first. They basically wanted someone’s scalp.

Actually, I have no ire towards the police; I respect them and appreciate them. However, I prefer to interact with them at a distance, with a smile and a wave.

Lawbreakers always say that.

I’ve had some cop friends. They were great friends, though a couple were a bit crooked themselves. Nobody’s perfect. I liked having them around in the bars.

But how many times has NYC let thugs walk, who have been convicted DOZENS of times for serious crimes, only to go on to murder someone? This is an outrage, and Alvin Bragg is a monster.

Tell that to the folks in the U.K. - 4,000 of whom have been charged with ‘hate crimes’ for posting they don’t like their country being invaded or daughters and granddaughters raped by said invaders.

This is a POLITICAL PERSECUTION of white people to get them to move out of our major cities so Dems can dominate those stuck in the hellholes they’ve created.

Look at the guy who defended a woman on the subway = charged with murder.

See the pattern?
