During a press conference in the Oval Office on Thursday, President Trump signed a Presidential Memorandum which instructs U.S. Attorney Jeanine Pirro to "fully implement the death penalty here in Washington DC."

In additon, they should cancel the lethal injection and bring back the chair or the gallows or the firing squad.

I’ve lived in DC for a long time. I frankly don’t know if we have a death penalty for anything in the city per DC law, but I doubt it. We would have the death penalty for federal crimes for which the death penalty is prescribed under federal law, just as would anyplace in the U.S.

In any event, legislating the death penalty is up to Congress or the city council. A president cannot impose one by decree.

So what is Trump trying to do here? Is he directly Pam Bondi to bring federal capital charges against anyone arrested in DC whose offense can arguably be stretched to fit the relevant federal statue?

Putting aside the tendentious overreach, the issue here would be overcharging. Want to guarantee that a perp walks? Grotesquely overcharge him. That will usually do the trick.

Once again, the twitter bot wants to dominate the next news cycle. This is probably not thought through any further than that.

Short Answer: Yes, President Trump can push for the death penalty in Washington, D.C., for federal crimes, as federal law supersedes local D.C. laws, which abolished capital punishment in 1981.

Trump can impose the death penalty in D.C. for federal crimes by leveraging federal jurisdiction, as outlined in his 2025 memorandum and executive orders.
Plus you Democrats don’t control congress either.
Nor do you control SCOTUS.

It is not judicial over-reach. It is guidance to his prosecutors to flip the prosecutorial discretion back from the massive pendulum Soros swing to the left. It is entirely within the Executive Branch.
