I’ve lived in DC for a long time. I frankly don’t know if we have a death penalty for anything in the city per DC law, but I doubt it. We would have the death penalty for federal crimes for which the death penalty is prescribed under federal law, just as would anyplace in the U.S.
In any event, legislating the death penalty is up to Congress or the city council. A president cannot impose one by decree.
So what is Trump trying to do here? Is he directly Pam Bondi to bring federal capital charges against anyone arrested in DC whose offense can arguably be stretched to fit the relevant federal statue?
Putting aside the tendentious overreach, the issue here would be overcharging. Want to guarantee that a perp walks? Grotesquely overcharge him. That will usually do the trick.
