From the decision, as quoted in the article:

Despite Congress’s clear intent to not create a completely universal and automatic birthright citizenship policy, the current application of the Citizenship Clause is so lax that the United States has a de facto universal birthright citizenship policy that denies U.S. citizenship by birth to no one.

There is no federal requirement that hospitals ask new parents if they are foreign diplomatic staff. State agencies do not instruct hospitals to differentiate between children born to diplomatic staff and those born to U.S. citizens or temporary or illegal aliens.

Hospitals need to be instructed by law to ask these questions.

The Social Security Administration (SSA) does not investigate whether SSN requests are for children of foreign diplomats.

We need to order them to do so.

Congress could require parents to have SSNs before a U.S. birth certificate or SSN is issued to a newborn.

This should be enacted immediately, and enforced, with no back doors for the Gavin Newsom types to get around it.

Yes, more information needs to be collected and shown on the U.S. birth certificates about the parents such as their nationality and their reason for being in the country. Fields need to be provided for the father and mother to answer those two key questions. Those questions already appear on the National Security questionnaire form SF-86 which I discussed for another needed use of that form here: https://cdrkerchner.wordpress.com/2023/05/07/transparency-requirements-for-candidates-for-president-and-vice-president-more-is-needed-in-our-modern-electoral-process-filing-the-oge-financial-disclosure-form-278e-is-mandatory-the-opm-na/

Some examples for possible answers for the new needed fields on U.S. BC’s. For diplomats maybe “Honduran” and “Diplomat” for the reason for being in the country. A tourist mother would answer like ... “Chinese” for nationality and “Tourist” for reason for being in the country. Students here on a VISA would answer like ... “Saudi Arabian” for nationality and “Student” for reason for being in the country. And illegal alien parents would answer like ... “Mexican” for nationality and reason for being in country “undocumented alien” if they want to use that PC term.

To Help Solve the Birthright Citizenship Abuse Issue, We Will Need Better Birth Certificate Data Going Forward: https://cdrkerchner.wordpress.com/2025/05/23/to-help-solve-the-birthright-citizenship-issue-we-will-need-better-birth-certificate-data-going-forward/

A quick Chatgpt says no state birth certificates require the parent's SSNs.

Easy fix with a federal law requiring it as it relates to national citizenship.

Even if the numbers are fake any subsequent check, perhaps even submission of BC to Social Security when an SSN for the kid is requested would allow the vet of the ostensible parents before the kid gets an SSN.

So parent's SSN on birth certificates could be a real, easy fix to confirm valid new US citizenship status. I like it.
