For The First Time In 40 Years, The Federal Government Can Judge Applicants By Merit

The move opens the door to an elite federal workforce — and a major victory for President Donald Trump.

A decades-old court order that blocked the federal government from using tests to measure job applicants’ skills was terminated by a D.C. judge on Friday, setting the stage for an overhaul of the federal workforce that could be one of President Donald Trump’s most lasting achievements.

In 1981, Angel Luevano sued the federal government over the Professional and Administrative Career Examination, a test that helped identify the best and brightest out of the tens of thousands who apply for government jobs each year. Luevano argued that the test kept too many blacks and Hispanics out of government, and, in the waning days of President Jimmy Carter’s administration, OPM agreed to pause the test for five years.

Forty-four years later, the “Luevano Consent Decree” was somehow still intact. In January, the Trump administration filed a brief challenging the agreement — a feat which required reopening a decades-closed court case in which the original judge had died. The administration argued that it was doubtful the decree was ever appropriate, and that, with Supreme Court case law outlawing affirmative action, it was certainly not now.

Angel Luevano is still alive, and agreed to terminate the consent decree, court papers show. Luevano was represented by lawyers from Hispanic and black civil rights groups, two of whom did not return a request for comment.

For almost half a century, the federal government has operated like a college that didn’t look at SAT scores when admitting students. Rescinding the Luevano Consent Decree could take the government from safety-school status to Ivy League.

“We’re making civil service great again,” Office of Personnel Management Director Scott Kupor told The Daily Wire Friday.

This is one of the reasons there is bloat in the Civil Service.

There are a fair amount of DEI hires which have to be “worked around” in order to get the job done.

In some agencies, they may be close to majorities. I worked for the Department of Defense. It happened there, but probably not to the extent in say, the EPA or Health and Human Services...

I hope they actually do... Because from my experience working with government they purposely choose the most inept, egotistical, unproductive applicant they can. And that was even before Equal Opportunity... I think it is superiors wanting to make sure there is never any future competition for their own position... They are making sure their own position is safe from intelligent productive ladder climbers. Pure selfishness that creates hardships for the civilian population who have to deal with these inept egotistical individuals. And then they give these individuals God status with no appeal process, and no way to go over their head.

Many, many years ago, I took a Civil Service exam at a land-grant university for a computer operator position. There are about 40 of us in the exam room. My test score was 100 percent -- every question answered correctly.

I was ranked seventh. Bonus points were scored based on color and gender.

So, there is room for "merit" to be subject to the proverbial DEI thumb on the scale, if TPTB want to make it so.

Another factor in this is when the agencies were based on merit, many of the agencies actually had intentions of doing what was best for the country.

Over the last 40 years, many of the agencies have come to have intentions of doing what they thought was best for “the world” or for “world government” or anything except the USA.

Absolutely spot on. Since 1965 their loyalties are to a remote global authority and agenda.

What are you, on drugs? It will be Indians and Asians now filling the government jobs, assuming that they heavily count the test scores. Still better than having “Diversity” in the federal workforce.

Imagine the NBA handling this ... ermagerd, we better lower the hoops or hell, eliminate standards altogether. If blacks and browns can't cut it STUDY UP and become a better applicant, duh.

Your story sounds like my ex's story with the California Highway Patrol back in the '80s.

Aced the written test, aced the physical test ... yet scored lower than the fat black women test takers because they got extra points for being black and being women. The sergeant who was administering the tests admitted that they were forced to.

It was at that point he was so outraged at the injustice he said F this and went to college and got his computer science creds.

Years ago I applied for a government job as a postal carrier. I passed the test with flying colors but didn’t get the job. I told a mail carrier friend I had applied but was rejected and he said, “ not a minority, not a female, not ex-military you stood no chance.” Whatever happened to MLK’s ‘content of character’ adage?

I can almost hear the screams of “Racism Racism” now. So let’s see. Why not apply percentages to say, football or basket ball? Blacks are only about 12% of the US population so let’s only allow 12% those sports positions to be filled with blacks. No you say. Those positions are filled by those with the most talent and black obviously have the most talent for that. Now let’s look at air traffic controller positions. Let’s fill them with people with the most talent for executing that job. No No you say. Because of Equity we must allow any person, especially minorities, to have those jobs even of it means we lose a few planes in the process.
That seems to me to pretty well describe the attitude some folks have today.
