‘We live in response to a monarchy’: Judge appears critical of deployment of National Guard in L.A.

A federal judge in San Francisco expressed skepticism at a hearing Thursday that President Trump had the authority to federalize the National Guard, questioning whether he had followed the law before ordering an extraordinary deployment to Los Angeles over the weekend.

U.S. District Judge Charles Breyer, presiding over the case, pushed back against the Justice Department’s central argument, that courts had no say in the matter.

“We’re talking about the president is exercising his authority, and of course, the president is limited in his authority,” Breyer said. “That’s the difference between the president and King George.”

“We live in response to a monarchy,” the judge continued, adding: “Line drawing is important, because it establishes a system of process.”

In the lengthy hearing, Breyer directed most of his questioning to the Trump administration, which has cited Title 10 of the U.S. Code to justify the takeover of the National Guard. But that provision, the judge noted, requires that orders from the president “shall be issued through the governors of the States.”

“I’m trying to figure out how something is ‘through’ somebody, if in fact you didn’t send it to him,” Breyer asked. “As long as he gets a copy of it at some point, it’s going through?”

No injunctions. No mouthing off judges.

In his 1995 SOTU address, a badly defeated Clinton sounded like Trump on illegal aliens and used the word illegal.

No whining by media, Dems, etc.

Do kings serve fixed terms? Are they term-limited? Are they subject to removal by the legislature? Can they be replaced by the vice-king by a majority vote of department heads?

I hope Trump is putting out, over the grapevine, that he’s not going to stand for summary dismissal of the proper power of the executive. That he’s going thru the motions of responding in court and putting a nice face on it but that the appeals courts/SCOTUS better do the right thing. OR THEY’LL BE RESPONSIBLE . Because if he ain’t then they’ll roll right over the presidency as they damn well please.

Then explain to us how low level judges suddenly have the power to override Executive Branch actions. Isn’t that insurrection?

These folks will be very disappointed as more troops are deployed, more ICE raids take place and more illegals are removed from circulation. The cities will be left in shambles and Trump will be laughing at their requests for federal aid. And they will have accomplished nothing.

By the time of King George, Magna Carta and the internal wars of the late Middle Ages attenuated the powers of the King greatly. You can make the case that a British subject in the late 18th Century had more freedoms than a U.S. Citizen today, depending on what you want to do.

Well, Judge - thank you for proving the falsehood of your statement. The fact that we are questioning, ridiculously questioning the presidents powers here and you havent been arrested for doing so - means it is not a monarchy. no monarch would suffer such.
