Why did the court strike down some tariffs?
The U.S. Court of International Trade ruled that President Trump didn’t have the authority to impose sweeping tariffs under the International Emergency Economic Powers Act of 1977, or IEEPA.
What tariffs are covered by the ruling?
The ruling voids many of the Trump's administration’s moves on trade. That includes fentanyl-related tariffs on Canada, Mexico and China, and the reciprocal tariffs—some of which were already on hold—that affect virtually every U.S. trading partner.
What tariffs aren’t affected?
Those that weren't justified under IEEPA. For instance, levies on autos, steel and aluminum aren't covered.
Will the White House contest the ruling?

“Will the White House contest the ruling?
“Yes, lawyers for the Trump administration said they will appeal. Appeals from the trade court are heard by the U.S. Court of Appeals for the Federal Circuit and ultimately the Supreme Court.
“What happens next—can Trump use other legal tools?
“Yes. Tariffs on cars, steel and aluminum were justified based on national-security concerns under Section 232 of the Trade Expansion Act of 1962. Similar duties are already planned for sectors like lumber and semiconductors.
“The administration has contemplated using Section 301 of the Trade Act of 1974, which allows for tariffs that counter unfair foreign trade practices. Trump invoked that provision to impose his first-term tariffs on China and it is considered to be on firmer legal footing than IEEPA.
“What does this mean for global trade talks?
“Resetting trading relationships with other countries could be more complicated. “We believe one reason bilateral negotiations had stalled was that U.S. trading partners may have anticipated this outcome,” wrote analysts including Aniket Shah at Jefferies.”
Levin shouted that this is UNCONSTITUTIONAL!
The Trump admin has already filed a notice of appeal.
Agree!
Who brought this case against Trump (who is plaintiff)?
I was checking that pesky constitution thingie and can’t find an international trade court anywhere....
“U.S. trading partners may have anticipated this outcome,”
So how much did they pay this judge to rule this way?
Courts other than the Supreme Court are established by statute. Even the Supreme Court has an implementing statute,
Even Goldman Sachs doesn’t think this ruling will stick.
The Constitution section 1 article 8 gives trade to Congress. Section 3 gives Congress the power to create courts. Even this one.
Who knows. How much did Apple Pay?
The AGs of Arizona and Oregon and 12 other states joined.
This is becoming ridiculous. Note to all of you “judges”. You are going to cause things you can not stop/correct, no matter how much remorse you have.
Trump will continue to act like appealing thru the courts to all of this unconstitutional micromanaging is the thing to do…until he can’t any more. Then, when he must assert constitutional executive authority, the deepstate will spring the trap, including enough republicans and they, and what’s left of the msm, will, sadly, and with great regret, lament the chaos and lawlessness brought by Trump and they will do their duty and restore our law and democracy. He will be impeached and convicted. They can be aiming for no less. They HAVE to do this because he is destroying their grift.
It was three judges. Two republicans and one democrat. Trump judge and a W judge and an Obama judge.
Does the International Emergency Economic Powers Act of 1977 override the U.S. Constitution?
Posting something like that is going to cause problems.
The Trump administration is a paper tiger. Trump has made it clear that in all cases he will defer to the court . If SCOTUS ruled tomorrow that the President can deport anyone for any reason there is nothing that prevents a lower court from writing a different decision the next day and stopping the deportation. The Trump administration would then go through the whole process again rather than just sighting SCOTUS and never stopping the deportation. Trump is afraid of being labeled a dictator or being seen as defying the courts and so long as that is the case he and his administration are paper tigers. The process is the policy and the punishment just like they did to him as a private citizen.
Just typical Dem tactics. I think the court is exceeding its authority.
That may be the title in the Constitution...but there are a lot of attachments that came along. That makes your post...a half truth...not the WHOLE truth and nothing but the truth.
