Traffic charges dropped against Georgia college student now facing deportation

Charges have been dropped against a 19-year-old college student who was arrested during a traffic stop in Dalton earlier this month—a case that has drawn national attention and sparked outrage among immigration advocates and members of the community.

The City of Dalton confirmed Monday that all charges against 19-year-old Ximena Arias-Cristobal were dismissed after a review of police dash-cam video showed she was not the driver who committed the traffic violation that led to her arrest on May 5. Arias-Cristobal had been cited for making an improper turn and driving without a valid license. However, Dalton police now say she was mistakenly identified. "Miss Arias-Cristobal's vehicle was very similar in appearance to the offender vehicle," Dalton Police Assistant Chief Chris Crossen said.

According to the city, video from the incident revealed that a black pickup truck made an illegal right turn at the intersection of Walnut Avenue and Thornton Avenue, where right turns on red are prohibited.

Arias-Cristobal, a student at Dalton State College, was driving a dark gray pickup truck that happened to be part of a line of cars turning left at the same time the officer attempted to pursue the actual offending vehicle.

When the officer caught up with her near Crawford Street, he stopped her vehicle and made contact. Audio of the initial interaction was not recorded. "It's a situation where the wrong vehicle was stopped, and it's a very regrettable thing that this is where this led," Chief Crossen said.

The Dalton Police Department, the prosecuting attorney, and city officials reviewed the video and determined Arias-Cristobal’s vehicle was not the one that committed the traffic violation. She was cleared of both the improper turn and license charges, and the City Attorney notified her legal representatives of the decision to drop the case.

No fabricating. The video clearly shows the cop pulled over the wrong truck. Given that this won’t affect her immigration case, why would they bother to make this up? It just makes the cop seem incompetent.

I remain unconvinced by the video.

Like I said...this is about race and its history in the South.

They have now conflated opposition to illegal immigration with racism.

As for making it up, it’s a way to back out of the immigration charges as well - exclusion of evidence due to lack of a legal stop, for example.

Mexicans are the New Negros. They will now assert the same privileges: keep your laws off of me!

And the terrified Caspers will comply.

Correct. BUT, when they stopped her, they found she did not have a valid state DL, only an International Driving Permit. She has been in the USA since age 4, so it’s a mystery how she would have gotten a home country (Mexico) DL that would have qualified her for an IDP.

When I used IDPs in my international travels, I also had to have my home country (USA) driver license. The DL and IDP work together.

So there was no reason to drop the “Driving without a license” charge.

She broke the border and in the process effectively gave U.S. citizens the middle finger. I don't care what kind of cutesy photos of this wetback you come up with, she violated the law, and she's ILLEGAL!!!!!

No, the officer has to be able to articulate a reasonable suspicion for stopping the vehicle. Seeing a black Ford with black rims and a silver toolbox in the bed making an illegal turn does not give you reasonable suspicion to stop a dark gray Dodge with silver rims and no toolbox in the back, especially when the video shows you drove past the black Ford.

No matter what the outcome of this young woman’s case is, we MUST ensure that the legal principle of “Being an illegal alien illegally in the country” is in and of itself a sufficient reason for immediate deportation!!

We are beginning to behold a new “normal” that is being created that would have you believe that the illegal alien status MUST also be accompanied by other criminal charges to justify removal!

Sounds like a local thing. As regulator points out upthread, "it’s a majority “hispanic” town at 55%...a Mexican colony".

In other good news:
"Arias-Cristobal’s father, Jose Francisco Arias-Tovar, was also arrested recently in an unrelated traffic incident for speeding and driving without a license. He is being held at the same ICE facility. "

Your post says “right past the truck that made the illegal u-turn”.

The stop was supposedly for a truck that turned right on a red. Nobody said nothin’ bout a U turn.

There were definitely two Dodge Rams that turned left in front of the cop at the intersection of Thornton and her truck was the first one. Undoubtedly not the Ford that passed in front of the dashcam when the cop was parked.

But we don’t see what happened at the intersection that the cop said he observed. The “black truck” that supposedly did a right turn on red at Thornton.

And then Junior pulls out, stops behind the Versa and turns right when he gets a light, and first drafts Ram Truk #2 before pulling out and around to get Ram Truk #1.

Other then not having the trailer mirrors, doesn’t look like Ford Truk whut passed in front of the dash cam. So why’d he stop it? The Ford was never in sight when he turned right on Thornton.

My response is that the whole “turned right on red” was BS to start with. Cops know make/model of virtually all vehicles, they see them / stop them all day long. And in the South, Bubba the Bearded Traffic cop mistakes a Ram for a mid-2000’s F150 XL? Really? He’s one outta the loop Bubba.

I think he knew what truck he wanted to stop all along and fabricated the story from the start. Maybe you think that’s a bit far fetched but police don’t always want to say WHY they actually know what they know. Might give away something.

And now they’re going to get it all dismissed because like you said, “fruit of the poisoned tree”. How convenient.

And Xiomena gets to become the poster girl of the poor, persecuted Un-Documented. Oops.

It trumpets the rise of hispanics in Georgia, since that will push Whites into minority status by 2045, after which Victory over the Hated Whiteys will be assured forever.

Thus NO Deportations will be allowed by the Gangster State. Not when Victory is in sight.

So like I said at the beginning...the whole story seems bogus to me. How often does a traffic stop like this become international news? Was it really a mistake, or something else?

Enjoy being a minority there in JawJuh. The new overlords ain’t gon be anywhere near as genial as the old ones.

"In Georgia, driving without a valid license is considered a misdemeanor offense. The penalties for a first offense can include up to 12 months in jail or a fine of up to $1,000."

Most likely she didn't have insurance and the car wasn't registered. Happens all the time in California - where lefty pols say "unlicensed illegals need the cars to get to work" - and the unregistered uninsured cars are no longer towed, the drivers not even cited.

These types cause a LOT of accidents, many of them fatal and they should be punished and taken off the road.

Dalton/Whitfield County has a very high hispanic population. I would not be at all surprised if this was a fabricated tale to cover for the girl and try to keep the natives happy.
