U.K. Supreme Court rules legal definition of a woman is based on biological sex [Landmark Ruling]
BBC Live ^ | April 16 | BBC Live

Summary

- The UK Supreme Court rules that the legal definition of a woman is based on biological sex

- Judges say the "concept of sex is binary" while cautioning that the landmark ruling should not be seen as victory of one side over another

- Transgender people still have legal protection from discrimination, the court adds

- Today's decision comes after a long-running legal battle between the Scottish government and a women's group

- The Scottish government had argued that transgender people with a gender recognition certificate (GRC) are entitled to sex-based protections, while For Women Scotland argued they only apply to people that are born female

"This has been a really, really long road," says Susan Smith, the co-founder of For Women Scotland.

She says: "Today the judges have said what we always believed to be the case, that women are protected by their biological sex.

"Sex is real and women can now feel safe that services and spaces designated for women are for women and we are enormously grateful to the Supreme Court for this ruling."

This is a real step forward, and important to the security of women. UK has been taking a hard look at the transgender campaign and not liking much of what it sees. The whole domain of transgender surgery for minors, eg, has been severely curtailed following a scathing government- sponsored review of the science.

Those who understand binary, those who don’t, and the truly stupid who think nonbinary is a thing.

I remember way back in my childhood when my teacher discussed psychology. He discussed 'Reality Testing' which was developed by Sigmund Freud.

He developed it for adult patients that trouble determining a situation for what it really is, rather than what they hope or fear it might be.

Children normally learn this in the natural course of growing up. They learn that fairy tales are not real, that most of what they see on TV is not the real world.

But the world of WOKE has perverted reality testing in to a world of paranoia where people of a certain complexion are born evil and people of another complexion can not be held responsible for their actions because of their status as a oppressed people. There are no individuals responsible for their own actions.

There is binary for the WOKE. The binary of evil oppressors and the oppressed.

For the WOKE all of reality is viewed through a filter of ideology and true reality can not be viewed as it is.

What is truly sad for these mentally handicapped is that their fantasy changes so frequently that it impossible to keep their focus. So, any challenge to their world view triggers violent anger.

The Left's common bouts of violence are probably rooted in their poor reality testing skills.

The UK Supreme Court needs to send that information to one of the idiot SCOTUS justices so she will know what a woman is.

"the biological characteristics that make an individual a man or a woman."

The skeletal content of the living and the dead would be especially revealing, and I would think that x-ray imagery would be admissible as evidence in courts of law.

I agree. And IMHO, some of the people who state their belief in the WOKE cult stuff don’t really believe it. They’re afraid to be seen as different from everybody else.

Good luck on getting the U.S. Supreme Court to do a logical thing involving sex ID’s.

I take it you’ve pinged me this with your parenthetical ‘terrible idea’ in mind.
In what way a terrible idea?
There’s always been a court of final appeal.
There were problems with the SC’s predecessor, not least its name and the constitutional muddles arising therefrom. Whether the present arrangements are a better solution - well, it’s only 16 years old, and on this I’m with Chou En Lai’s verdict on the impact of the French Revolution - ‘too early to say’.
As it happens, I have a personal interest in another case on which the Supreme Court is expected to pronounce shortly - the right to wild camp on Dartmoor. Such are the incongruities of the law.

Well, I defer to your extensive experience with Westminster-style responsible government.

It has its good and bad points. One of the good ones (IMO) is the Crown in Parliament as the final authority.

Our separation of powers (a reaction to the final authority of Crown in Parliament) sometimes creates conflicts with no clear path to resolution, one of which we are having right now.

Once your Supreme Court really gets going, you may find many things become “unconstitutional” that have broad popular support, while other things that no one wants become required.

Best of luck with it.

Well, Parliament still does have final authority. The Supreme Court has final authority on the law as it is. But Parliament can change that law at any time, just as it can suspend, abolish or reform the Supreme Court at any time. The existence of the SC in no way weakens the sovereignty of Parliament.

While I’m glad to hear it, I’m truly surprised at this decision in today’s UK.

They should follow this Anglo ruling! Pretty big!

The woman’s group spokesman was in TEARS. She said they spent years fighting this and now women’s and girls spaces are protected.

Imagine seeing this on the BBC. I was shocked I tell you! What a day.

The UK SC is quite new and modelled on the US version where there are multiple participants (I think 12)

Previously, a final appeal could be heard in the House of Lords and judgements were read there. It was very peculiar

So they came up with an SC to separate things.

I think it works better than previously and they have modernized it.

They will still issue landmark rulings like today which is what is expected from them.

They’re even doing it on TV cameras which is a new one and something SCOTUS declines.

“He discussed ‘Reality Testing’ which was developed by Sigmund Freud.”

Is it the cousin of Sigmund Fraud, you know, the guy who developed the idea that babie boys want to f.ck their mother and kill their father?
