Today, the U.S. Department of Education (ED) referred its Title IX investigation into the Maine Department of Education (MDOE) to the U.S. Department of Justice (DOJ) for further enforcement action. Simultaneously, ED will initiate an administrative proceeding to adjudicate termination of MDOE’s federal K-12 education funding, including formula and discretionary grants.
These actions are a direct result of MDOE’s continued refusal to comply with Title IX. ED issued a noncompliance finding on March 19, and sent a final warning letter to the state on March 31.
“The Department has given Maine every opportunity to come into compliance with Title IX, but the state’s leaders have stubbornly refused to do so, choosing instead to prioritize an extremist ideological agenda over their students’ safety, privacy, and dignity,” said Acting Assistant Secretary for Civil Rights Craig Trainor. “The Maine Department of Education will now have to defend its discriminatory practices before a Department administrative law judge and in a federal court against the Justice Department. Governor Mills would have done well to adhere to the wisdom embedded in the old idiom—be careful what you wish for. Now she will see the Trump Administration in court.”

Now that's telling it like it is! Whoever would have thought a senior government official would state such a simple truth so plainly.
Now how does the administration get Administrative Law Judges on the case who will rule sensibly?
“Proceeding” what? They want to cut off the funds and they go LOOKING for a judge?
This looks like judge shopping in reverse.
They were warned, even directly warned, by the president.
But the phrase “ED will initiate an administrative proceeding to adjudicate termination of MDOE’s federal K-12 education funding.”
Sounds like a long winded way of saying the act of defunding is not going to happen today, before dinner, Friday, 4/22/25 Central Time. So maybe, just maybe, the state of Maine has a little time to fix this, if they want to.
At this rate we won’t ever get the Department of Education abolished.

That was my concern as well. Administrative Law judges have been a real problem in the past.
Why send One dollar to DC to send One cent back to where it came from? Abolish the education dept., it is nothing more than a make work project for bureaucrats. Enough!!!!

Why do they need the DOJ? Just cut it off. If they had to rely on the DOJ, they will be waiting a very long time.
Not nearly as much as you think. There's a 10th Amendment doctrine known as the anti-commandeering doctrine that prevents the federal government from using funds as a bludgeon to force a state to do something that the federal government otherwise does not have the power to compel.
The Supreme Court used that doctrine to strike down the Obama administration's attempt to compel states to expand Medicaid coverage under the ACA, or else lose ALL Medicaid funding. Court said that the federal government was entitled to withhold the extra funds that would have gone to expand Medicaid, but not the ordinary funds that went for the rest of the Medicaid program.
The moment the Trump Administration ordered a stop to all federal funding because of transgender athletes, it was a slam dunk win for the other side.
And don't shoot the messenger. I'm just telling you what the Constitutional doctrine is, and how it has been enforced against BOTH parties.
Title IX does have some mechanisms that will let the feds remove some funding that goes to athletics, but that it.

Some judge with ZERO jurisdiction will block the funding termination.
It’s worse than that. The “free” money from Washington means unqualified kids are going to college and taking bad classes that don’t lead to good careers. It allowed the government to push the idea that “everybody should go to college.”
The Ed Dept funds all the ultra-woke “research” graduate students and professors who churn out woke crap that flows into primary and secondary education. The “free” money allowed universities to raise tuitions far faster than inflation, making education even more unaffordable, even with all the student loans. Kids graduate with worthless, non-marketable degrees in crap fields and have to work decades to pay them off.
The whole Education Department scam has been a disaster of epic proportions.
Play by my rules or I cut off the money. Didn’t that start with the feds cutting off highway money if states did not impose a 55MPH speed limit on roads in that state? Sounds familiar. That’s been going on for a few years.
