Justice Department drops classified documents case against Trump co-defendants

The Justice Department on Wednesday moved to drop its appeal of a federal court order dismissing the criminal charges against President Donald Trump's former co-defendants in the classified documents case, which would effectively end the case.

Then-U.S. Attorney General Merrick Garland had cited the pending appeal as the reason why he would not publicly release special counsel Jack Smith's report on the criminal case he'd brought against Trump, saying it could impact the due process rights of the co-defendants, Walt Nauta and Carlos De Oliveira.

The Justice Department's motion to the 11th U.S. Circuit Court of Appeals to drop the appeal was filed by Hayden O'Byrne. O'Byrne was named interim U.S. attorney for the Southern District of Florida this week, the Miami Herald reported.

In a separate move Wednesday, the new acting U.S. Attorney in Washington, D.C., moved to dismiss a case against another Trump ally, former Republican Rep. Jeff Fortenberry of Nebraska.

O’Byrne's filing asks the circuit court to dismiss the DOJ's appeal "with prejudice," which means it could not be revived again at a later date. His office was assigned the case after Smith resigned earlier this month.

Biden's corrupt DOJ and Jack Smith really wanted the co-defendants to make up something against Trump in exchange for their charges being dropped. They refused to do it and their honesty and loyalty to Trump in the end paid off.

Will we ever know what actually happened?

Were there actually top secret docs?
When NARA left a pile of boxes in the white house driveway, did they plant some classified docs?
Did anyone escort the boxes of items from DC to Mar a Lago?
When the docs got there, were they really piled in the ballroom and restroom?
Who gave orders to move the docs to a secure place?
Is there any evidence that the docs were pulled from the piles and read by anyone?
When the docs were moved, is there any evidence that they were moved to sneak around?
Who gave the order to put a more secure lock on the storage room?
Who gave the order to raid Mar a Lago?
How did these two employees of Trump get implicated in a conspiracy?

That’s about half of the questions. Maybe one third.

I hope that Trump can find a way to reward them. Perhaps their old jobs can come back at a higher rate of pay

“With prejudice”?

Yes, with prejudice. They can’t refile the charges.

Speaking of dismissal of charges, here is another one.

Pay them out of the congressional slush fund, then shut the fund down. It first publish all the names.

I’m not even sure what that Fortenberry thing was all about, since the Nebraska 1st CD is 60% Republican all day.

He got taken out in 2022, and the seat was unoccupied from the end of March to the middle of July.

Were the documents the Crossfire Hurricane documents and was the DOJ that desperate to conceal them?
Who killed Seth Rich?

The Rats went after Fortenberry harder in 2020 than they had in over a decade, which might be why he felt the need to suddenly begin accepting money from any sources he could find?

“...wonder if they are financially near ruin.”

Got the feeling President Trump will find a way when things cool down a little, the $15 million from ABC, the $25 million he just got from Meta and surely there are other things going on is just the tip of the spear in addition to being a multi-billionaire. Plus, there’s gonna be investigations on the collusion of state’s attorneys general, DOJ and the like.

And don’t forget book deals!

That’s interesting.

They sure wanted to put him through the wringer.

What I really want to see is what happens to Menendez out in New Jersey. I know that he got 11 years - but did he REALLY get 11 years?

Trump has gotten two out of court settlements: 15 million from CBS, and 25 million from Meta. He will use the 25 million to build his presidential library. It will be fabulous, and Meta can look at it every day.
