Sharia courts exploit Britain’s rich traditions of religious freedom: 85 Sharia courts operating across the country

Britain has become the Western capital for sharia courts, with 85 operating throughout the country. The news hardly bodes well for those who still believe we have a functional integration strategy.

Not only are British Muslims increasingly turning to the UK’s sharia courts, but they also serve their co-religionists from mainland Europe and North America. Also known as “councils”, they have existed in the UK since the early 1980s and issue Islam-inspired rulings on family life and matrimonial matters.

The Islamic Sharia Council of Great Britain and Northern Ireland, formed in 1982 and based in Leyton, east London, is a registered charity that provides nikah (marriage) services, as well as overseeing talaq and khula procedures (divorce initiated by the husband and wife respectively).

What is perhaps more revealing is the normalisation of practices that are illegal under UK law – such as polygamous marriages. Polygamy is so normalised that an app for the creation of Islamic wills for those living in England and Wales has a drop-down menu for men to say how many wives they have (between one and four).

The app, reportedly approved by a sharia court, gives daughters half as much inheritance as sons. In addition to this, Muzz (formerly Muzmatch), one of the most popular matrimonial apps for British Muslims, has an option where male users can state their “polygamy plan” – whether they will seek a second wife or intend to stick with one. If a polygamous marriage is performed on British soil, the already-married person may be guilty of bigamy.

If this glimpse into the internal workings of sharia courts tells us anything, it is the fact that existing laws and regulations in the UK are not being properly implemented and enforced – especially when it comes to relatively segregated Muslim communities ...

The bloody Brits killed 11m Irish, incl. guarding bumper harvest exports to England during the potato famine with army troops. But they allowed Protestant Irish Lords to administer Breton Law. For homicide, Breton Law specifies compensation of the family from the killer’s clan. It drove the bloody British nuts.

Summary of another story:
China is believed to be operating secretive police outposts in North America, Europe and other places where there are Chinese communities. China has denied that they are police stations, saying that they exist mainly to provide citizen services such as renewing driver’s licenses.

The court system of the Uk is the law. How in the hell can a Sharia Court of law exist that is not part of of the English system of law?

I lived in the UK for a few years when working in the North Sea in oil exploration. I bought a house and was quite comfortable there. I considered staying there forever, but the oilfield went to hell in 1983 and I changed profession after going to university again to become a pharmicist. My son was born there and is a dual national. I could not vote but considered myself a loyal citizen of my second country. I had much the same liberties of speech there as I did in the USA, that is no longer. I would have fought in war for the UK. That grand UK is no longer. I would not fight for them if now living in the UK. I would fight for them as a citizen of the USA if so order by my government.

How in the hell can a Sharia Court of law exist that is not part of of the English system of law?

Because legally it has the same status as the rules of a golf club regulated by the club committee. Its rulings are not enforceable other than by the consent of those to whom they apply. If their enforcement doesn't include any act which is unlawful under common or statute law, then they're legal.

England's judicial system is the cornerstone of the legal systems of every civilized nation on earth. How they could allow these 9th Century pig fornicators to set up courts is beyond me.

There's a British lawyer...who calls himself "Black Belt Barrister"...who posts a lot of interesting stuff on youtube. I just might comment on one of his posts to encourage him to do a piece on "sharia courts".

Just out of curiosity...have you seen any of the youtube videos posted by “Black Belt Barrister”? I watch some of them and they’re pretty interesting IMO. Of course as a Yank I don’t understand some of the references he makes...but that’s OK.

Something just occurred to me: assuming that these “courts” uphold the right of a moslem man to have more than one wife does British law allow bigamy?

A simple law would end the sharia courts; a law that declares they are not legally binding, and abiding by them is totally voluntary. It does not even have to direct itself to Islam, and only declare ALL religious courts are not legally binding.

No. It's still illegal. But since none of the second, third etc 'marriages' are marriages within the meaning of the Marriage Act 1949 (as amended), (ie in the prescribed form and place and duly registered), they're not legally 'marriages' at all. They're a bit like the old notion of a 'common law marriage', which had no legal status. But if a Muslim (or anybody else) fraudulently went though a Registry Office etc ceremony when already legally married, that would be criminal bigamy.

However, if polygamous marriages have taken place in the jurisdiction of another country where they are legal, then the legal system recognises them as valid if those concerned are subsequently UK resident.
