NEW YORK - The jury in the Daniel Penny trial told the judge they couldn’t reach a unanimous verdict on the first charge of second-degree manslaughter, prompting the judge to issue an Allen charge urging them to make every effort to agree. One of the jurors was seen rolling his eyes as the instructions were read.
The judge reiterated the responsibility of the jurors to reach a decision, explaining that "deliberations were not intended to be easy," but that they should "harmonize" their views and reach a decision.
The defense has emphasized that the jury cannot deliberate on the second charge without resolving the first, as Penny cannot be convicted of both.
"It would be a crazy result to have a hung jury because they can't move onto the second count," prosecutor Dafna Yoran was heard telling the judge.

I'd be interested to know the racial and sex makeup of the jury.
Yeah, they’re going to do everything to push pressure on this jury, because it’s going to be harder and harder to convict as time goes on.
Throw it out!!
When I read that they did not reach a verdict yesterday and were dismissed for the day, I figured they were hung.
Just heard on Fox the jury wants to know what a “Reasonable person” means..the judge is going to force this jury to convict Penny the writing is on the wall..ANYONE with an IQ above 3 knows that Penny is a freakin HERO, he saved EVERYONE on that damn train that morning..but since Penny is white and the perp was black its automatic racism gotta convict Penny of something otherwise the blacks are gonna riot
Let some lunatic they've unleashed on the public attack them.
“...they should “harmonize” their views...”
Can you imagine how it must feel to be a juror told by a judge that you must “harmonize your views” with a fellow juror you’ve concluded has lost all touch with reality?
I had the foolishness trained out of me in law school, but most women are not fit to sit in judgment in matters of life and death.
You should have thought about that before you prosecuted the case, you wretched dog.
It is generally qualified by "without surrendering your judgment." Although for all I know, the trial judge took that language out.
Which would make a dandy enumeration of error on appeal. Most criminal convictions that are reversed fail for charging or evidentiary errors. Or both.
You must have attended a l-o-n-g time ago. I was disappointed to learn that two (2!) of the jurors were lawyers.
Uh, dismiss the case? Sounds like a good plan to me.
Free the hero Daniel Penny! And make the NYC subways safe!
>I had the foolishness trained out of me in law school, but most women are not fit to sit in judgment in matters of life and death.
Yeah, no logic, all emotion. I have a wife and three daughters.
“I’d be interested to know the racial and sex makeup of the jury.”
We won’t know that until ‘after’ the verdict. There is obviously at least one holdout standing up to the cretins for the truth (the chokehold didn’t kill Neely, he still had a pulse), vs. their lies.
I see a new day of patriots exhibiting new-found courage, and standing up and speaking out against the radical left and their BS, for a refreshing change. Trump’s election mandate has many such trickle-down after-effects, I suspect... that we will happily witness as time goes on. Even “if” this case ends up in a conviction, more folks will be encouraged to show resistance to the leftist tyranny and insanity that we have previously had to endure. At least, that’s the hope.
thx A
Crooked NY prosecutor and probably judge, Who knew ?
Especially the ‘judge’ telling them to get back in there and come up with a unanimous verdict !!
I’m going to guess they’ll be of the lefty female and black persuasion.
No matter what instruction the judge gives, you hang strong at Not Guilty. You only have to do it a few days. You cannot fold your arms and refuse to argue or they will remove you for failure to deliberate.
But just argue. “I don’t believe that witness”, “I think that evidence was suspect”, “I don’t see they proved X, Y, or Z” etc etc..
Just argue and be brave. Jury nullification ain’t just for OJ.
