I think it’s 10 days. 10 days of recess is needed for recess appointments to become final.

That’s why Senators never recess for that long. They’re called into the Senate. Then they leave for 4-5 days.

And so it goes.

Under article 2 section 3 the President only needs the cooperation of one house to recess the Congress. Thune is toothless and he knows it.

No he cannot.

The President cannot unilaterally “shut down” both the House and Senate to make recess appointments. The power to adjourn Congress is indeed limited and rarely used. Here are the key points regarding this issue:

The President’s power to adjourn Congress is outlined in Article II, Section 3 of the Constitution. It states that the President “may, on extraordinary Occasions, convene both Houses, or either of them, and in case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper.

Trump may try, but recess appointments are not gonna happen. In fact if he does try, there may be even greater pushback by both parties against his nominations.

Like Thune said.... Better to let the Senate do its job.

Do you remember when Trump nominated Ratcliffe for DNI and McConnell told Trump to pound sand? Trump unilaterally, with no confirmation, installed Grenell in the position with full powers for six months.

Why can’t Trump name Gaetz ACTING AG and Patel as ACTING FBI Director. In six months just flip their positions for another six months. Work Flynn and few others into the ACTING rotation and Trump’s in business!

And One More Time.

The Debt Ceiling is suspended and that suspension expires 1 January.

It will not be extended or raised until Trump is president because the House is GOP.

Then Trump is president and informs Thune that no business of Congress will proceed until he has his nominations confirmed.

He will veto any debt ceiling increase and they will not have the votes in both houses to override.

The govt will shut down, hard, and he isn’t running again and Does Not Care. He will blame the Senate for not confirming his nominations and name names as those responsible for the shutdown.

He will get all the GOP votes needed to confirm. They have no choice. The leverage is his.
