The University of Nevada said Monday it will move forward with its scheduled home match against San Jose State this month despite a team vote against playing.
Citing state laws and the Nevada Constitution, the university said in a statement to Nevada Sports Net it is preparing to play but will not punish team members who do not participate.
Earlier Monday, OutKick reported Nevada volleyball players were upset they were not consulted before the university said Oct. 3 it would play the match despite San Jose State reportedly having a transgender woman on its roster. The Spartans' roster is in accordance with Mountain West and NCAA regulations.
Below is the statement provided by the university:
"On Oct. 13, 2024, the majority of members of the University of Nevada, Reno women’s volleyball team sent a statement to the University advising the institution that they were forfeiting its scheduled match with San Jose State University on Oct. 26, 2024. The players’ decision and statement were made independently, and without consultation with the University or the athletic department. The players’ decision also does not represent the position of the University.
"The University and its athletic programs are governed by the Nevada Constitution and Nevada law, which strictly protect equality of rights under the law, and that equality of rights shall not be denied or abridged by this state or any of its subdivisions on account of race, color, creed, sex, sexual orientation, gender identity or expression, age, disability, ancestry or national origin. The University is also governed by federal law as well as the rules and regulations of the NCAA and the Mountain West Conference, which include providing competition in an inclusive and supportive environment.
"The University intends to move forward with the match as scheduled, and the players may choose not to participate in the match on the day of the contest. No players will be subject to any team disciplinary action for their decision not to participate in the match."
The Nevada volleyball team sent a statement to OutKick on Monday saying it would not play against San Jose State, with Wolf Pack senior Sia Liilii saying players on the team were frustrated Nevada athletics announced it would play the Spartans without talking to the team.Four schools have declined to play San Jose State this season, including three in Mountain West action.
"The school released that statement without consulting our team at all," Liilii told OutKick. "We were pretty upset that we were not made aware that a statement was going to come out. We were actually in Las Vegas preparing for our match against UNLV, our in-state rival. It was a really frustrating time, especially because we were about to go and play a big game.
"We decided that we're going to stand in solidarity with other teams that have already forfeited and that we wouldn't participate in a game that advances sex-based discrimination or injustice against female athletes."
Southern Utah was the first school to decline to play San Jose State, doing so Sept. 14. MW schools Boise State, Utah State and Wyoming also have opted out of playing the Spartans, which is considered a forfeit and loss, per MW rules. Nevada is scheduled to play San Jose State just once this season, that coming in 12 days at Virginia Street Gym.
The San Jose State player in question is in her third season with the program with no previous cancelations of contests. The NCAA's transgender student-athlete participation policy, which was updated in May, requires transgender female athletes to have met a serum testosterone requirement for at least one year and show proof at the start of the competitive season, with further documentation before any championship competition. San Jose State's roster is fully compliant with NCAA rules.
San Jose State coach Todd Kress said players on his team have been subjected to hate mail.
"Some of it, to be honest, is disgusting,” Kress told local media. “I’m more worried about our student-athletes and what they receive and how that’s impacting their mental health.”
San Jose State is 9-3 overall and 4-3 in the MW. After starting the season 9-0, the team has lost three straight MW matches, including a 3-0 defeat to Colorado State, a 3-0 defeat to San Diego State and a 3-1 defeat to UNLV, the Silver State's other Division I athletic department that opted to play the Spartans. Nevada is 10-8 overall and 3-3 in the MW.
Nevada coach Shannon Wyckoff-McNeal, who has led a strong year-one turnaround of the program after being hired in December, told NSN last week the Wolf Pack intended to play the Spartans.
"There's all kinds of discussions," Wyckoff-McNeal told NSN last Wednesday. "All the players know all different players in all different schools. There's just so many things coming at everybody. We've tried to answer questions, be straightforward, I've been nothing but honest with them in answering questions. Our administration has been answering their questions, kind of working through scenarios and that kind of thing. At the end of the day, I told my team, 'I will support you no matter what. I'm behind them 100 percent.'"
It will be interesting to see how many of Nevada’s players will have the courage to say “no”.

How are you going to field a team if they all will not play. You can try and make them play, but they can just play lousy and throw the game.
I hope no players show up for the game. Time to take a stand.
I’d wager they won’t have enough willing players to field a team, and end up forfeiting anyway as a result.
