Man who sold fentanyl-laced pill liable for $5.8 million in death of young female customer

In 2019, Brandon McDowell was contacted by a sophomore in college who asked to buy Percocet, a prescription painkiller.

What the 20-year-old sold her instead were counterfeit pills laced with fentanyl, a deadly synthetic opioid that can be lethal in a dose as small as 2 milligrams. Hours later, Alexandra Capelouto, also 20, was dead in her Temecula, California, home.

It is an increasingly common scenario as fentanyl overdoses have become a leading cause of death for minors in the last five years, with more than 74,000 people dying in the U.S. from a synthetic opioid in 2023, according to the U.S. Centers for Disease Control and Prevention. McDowell has been behind bars since 2022 with a fentanyl possession conviction. But the Capeloutos have now won an additional $5.8 million judgment against him for the death of their daughter.

Did McDowell provide some sort of guarantee of authenticity? She should have gotten a prescription and gone to a pharmacy. You honestly have no idea what you’re getting with an illegal drug deal — for that matter, you should probably expect cheap fentanyl to be an ingredient.

Brandon McDowell was being held at the federal prison in San Pedro during the lawsuit and did not have lawyers to defend himself in civil or bankruptcy court.

Amazing legal system. Is this justice? Maybe their daughter should have said no. She’s the only one who seems to be avoiding any responsibility here.

She got the death penalty. Isn't that punishment?

Chauvin was political. Nothing about his trial was legal. From Jury selection to sentencing. It[his trial and sentencing] demonstrated that our has been thoroughly corrupted . And it also exposed the fact that the general public gives not one damn. And the corruption continues unabated until today [September 16, 2024].

And the family will get precisely zero from the punk. I want to know if he’s being charged with manslaughter...or murder.

Buying drugs from someone other than a pharmacist. What could possibly go wrong.

No sympathy.

If McDowell had knowingly given her HIV, all would be well and good legally.

But she isn’t being held liable for any contribution on her part. Lots of blame to go around, probably, but she is ultimately the one who made the decisions that culminated in a fatal overdose. So I don’t see why her estate should be awarded money.

If the dealer had forced her to ingest tablets, or if he sold her an apple full of fentanyl when she was just looking for an apple to snack on and not an illegal drug, that would be a different story.
