A Post Falls resident may begin collecting a $1.1 million judgment against the blogger who defamed him, a judge ruled Wednesday.

In May, a Kootenai County jury unanimously found that Summer Bushnell defamed Eric Posey when she falsely accused him of exposing himself during Pride in the Park 2022.

Bushnell asked the court earlier this month to stay enforcement of the judgment while she appeals the case. First District Judge Ross Pittman denied Bushnell’s request Wednesday. “It’s on you, Ms. Bushnell, to show good cause, and you have not done so here today,” Pittman said.

Bushnell, who is now representing herself, argued in court that she’s unable to pay the judgment because her household spends more money than it earns each month. She said her husband is the family’s sole breadwinner and she “occasionally receives payment for helping local political candidates with their campaigns.”

Court records indicate Bushnell’s household lost tens of thousands of dollars last year in cryptocurrency investments. Legal counsel for Posey pointed to these losses as a reason why judgment should not be stayed until after the appeal process is complete.

In Idaho, a district court may not stay enforcement of a money judgment unless the party against whom the judgment is entered posts a cash deposit or a type of surety bond equal to 135% of the judgment. Bushnell has also asked the court to waive or reduce the bond to no more than $10,000. The court denied that request determining that “simple inability to pay” is not good cause to waive the bond, nor to stay enforcement of a judgment.

After public outcry, the allegations were reviewed by the city’s prosecutor’s office. A press release from the Chief Criminal Deputy Attorney, Wes Somerton, dated June 30, 2022, stated, “This office reviewed both the unedited video recording of the incident, and the edited video recording that has been widely circulated on various social media platforms. The unedited video recordings do not depict any exposure of genitalia. The allegations of indecent exposure, or other crimes, cannot be supported by the evidence. Therefore, prosecution is declined.”

The jury agreed with Somerton’s review of the video, and found that Bushnell either knew her allegations were false when she made them or had reckless disregard for the truth, awarding $926,000 for defamation and another $250,000 in punitive damages.

Hours spent looking at the video to determine if he exposed his Johnson. What a waste of time and what a horrific judgement. It's the ruin of the Bushnells.

That's all you. Clearly you haven't had a lot of interaction with me, but i've been here since 2011, and i've been arguing with people online since the early 1990s.

I seldom if ever, call anyone names for disagreeing with me. What is the point? People see themselves as rational, intelligent and mostly open minded. If you tell them otherwise, they simply reject it without consideration because it is contrary to their own core beliefs.

No one thinks of themselves as a fool. No one thinks they aren't rational, or aren't capable of complex reasoning.

I think f@ggots should not be allowed to walk around in society. I think they should be confined to mental institutions the way they were for most of this country's existence. And I have no idea if the woman lied. They claim to have proof that she lied, but I don't know if that's correct or not. Juries that would make such an insane monetary verdict, also cannot be trusted to exercise good judgement in determining other facts.

Juries are often nuts. The verdict against the Ralph's Grocery store chain many years ago was another example of an insane jury, which should have gone to jail for contempt when they came back with their ridiculous verdict.

The New York Jury that convicted Trump is nuts. The DC juries convicting these J-6rs for doing far less than the pussy-hats, Antifa, or BLM ever did, are all nuts.

*I* have no faith in juries doing the right thing. I have no faith in Judges doing the right thing. Our entire judicial system is a broken down dysfunctional mess.
