Justice Elena Kagan on Thursday defended the code of conduct the Supreme Court created last year, but conceded there needs to be a way to enforce the rules for it to be more effective.

“I think that the rules that we put out are good ones,” Kagan said at a judicial conference in Sacramento. “I think that the thing that can be criticized is, you know, rules usually have enforcement mechanisms attached to them. And this one, this set of rules does not.”

Kagan’s criticism of the court on Thursday was not limited to its new code of conduct. She also expressed frustration with the large number of concurrences her colleagues have been issuing in cases, which she described as “not a good thing for the court.”

Kagan also made clear that she was growing impatient with the increased use of the court’s emergency docket, in which the court can issue unsigned and unexplained orders that allow the justices to act on a case while also shielding the legal analysis behind the decision and the vote count.

Believe it or not, up until a few years ago, the SCOTUS was very cordial and interactive with one another. I got that from a SCOTUS judge speech I attended. Today, leftist pressurs have tried to poison that professionalism.

Believe it or not, up until a few years ago, the SCOTUS was very cordial and interactive with one another. I got that from a SCOTUS judge speech I attended. Today, leftist pressurs have tried to poison that professionalism.

I think it began with BO and his appointments. From what I remember, Antonin Scalia and Ruth Bader Ginsburg were political opposites but otherwise good friends.

Who would she put in charge of enforcement? The judiciary should not be shackled to legislative or executive discipline.

Maybe they can institute a "swear jar" type of self-enforced mechanism! LOL

Says the Justice who did not recuse herself from the Obamacare case despite her having attended strategy meetings about litigation involving it prior to being nominated and confirmed to SCOTUS. There is also an email she sent to Laurence Tribe expressing her excitement over the proponents of the bill having secured enough votes to pass the monstrosity. NEVER FORGET.

Why not use that standard for POTUS candidates too? No money from any other source and they both get the same amount to start with. Physical gifts no more than ten dollars and no cash gifts.

After all, POTUS is the highest office and money from special interests could influence the way the country is run.

You like that? But you do see that if a marxist violates this rule they will be given a pass and an excuse.

Rules are optional for many.

You have to start somewhere. It’s gross that Supreme Court justices make hundreds of thousands of dollars for gifts. That’s gotta stop. Let’s get some ethics going. It will better our country.

Honestly, I didn’t know she could think on her own. Sure she wrote this?

I don't agree with many of her rulings but Kagan is the smartest justice on the SCOTUS left flank, and likely the only one of the three who deserves to be there. Sotomayor has a reputation in legal circles as somewhat dim. KBJ, it might be too soon to tell though she has taken some interesting sides.
