Judge Cannon dismisses Trump documents case

U.S. District Judge Aileen Cannon has dismissed the classified documents case against former President Donald Trump in an order Monday morning over the manner in which special counsel Jack Smith was appointed.

“The Superseding Indictment is DISMISSED because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution,” wrote Judge Cannon, who was appointed to the bench by the former president.

You people always bring that topic up, even when it is not germane to the discussion at hand.

Wrong. Its absolutely germane.

The SAME US "deep-state" apparatus, the same woke political appointees that impeached Trump for talking to Zelensky, that manufactured lies about Russia-gate, that tied him up in 2 years of manufactured media BS with the "Mueller Investigation," that hid Hunter Biden's laptop, that now prosecute him on ridiculous classified documents charges - are the SAME people pushing US policy in Ukraine.

To say they are not connected is being deliberately obtuse.

It also means that Jack Smith has no prosecutorial immunity and to the extent he has through abuse of power not rightfully his, injured others with detainment, confinement, wrongful prosecution, etc.., he can be sued civilly.

No, this is just one instance. Even when President Trump was hit with a bullet the FRussian brigade was out in force. No matter what the topic is, they have to bring it up.

It is a bunch of terminally online malcontents being manipulated by half-assed propaganda but are too stupid and ideologically possessed to look at anything with even a modicum of objectivity. If China invaded the US they could be made to support China if it was spun the right way.

Cannon suggested in her ruling that she was leaving some of Trump’s major points in his appropriations clause challenge for review by an appeals court.

One of the arguments that Trump raised was that Smith’s appointment gave him a significant amount of power without the oversight of Congress. Former Attorney General Edwin Meese and Citizens United argued the same, writing that Smith’s appointment “severely undermines” the constitutional order.

Cannon wrote in her ruling Monday that the issue was “a point worthy of consideration given the virtually unchecked power given to Special Counsel Smith under the Special Counsel Regulations.”

“Ultimately, however, after examining the broad language in Supreme Court cases on the subject—and seeing a mixed picture, even if a compelling one in favor of a principal designation—the Court elects, with reservations, to reject the principal-officer submission and to leave the matter for review by higher courts,” she wrote.

None of the statutes cited as legal authority for the appointment…gives the Attorney General broad inferior-officer appointing power or bestows upon him the right to appoint a federal officer with the kind of prosecutorial power wielded by Special Counsel Smith," Cannon wrote.

"Nor do the Special Counsel’s strained statutory arguments, appeals to inconsistent history, or reliance on out-of-circuit authority persuade otherwise.”
