Wisconsin election law says only way to exit from ballot is death

Should President Joe Biden decide to exit the presidential race, Wisconsin law creates another impediment to Democrats replacing him.

Death is the only allowable reason for a candidate to drop out.

According to the state’s ballot access procedures, “Any person who files nomination papers and qualifies to appear on the ballot cannot withdraw their name from the ballot after filing. The name of that person shall appear upon the ballot except in case of death of the person.”

The Heritage Foundation, a conservative think tank, has identified states, such as Wisconsin, where Democrats could face legal challenges if they try to replace Biden.

“We are monitoring the calls from across the country for President Biden to step aside, either now or before the election, and have concluded that the process for substitution and withdrawal is very complicated,” Heritage Foundation Oversight Project Executive Director Mike Howell said in a statement. 

Even without this provision in Wisconsin’s election law, removing Biden from the ballot would prove difficult to accomplish.

However, I think they won’t go that route because the law means nothing to them. They’ll just have that provision of the law declared unconstitutional, or have the legislature repeal that provision. Easy peasy.

Biden is not yet even the nominee to be placed on the ballot yet, so “replacement” does not yet apply in this sense.

a judge will just throw that out and let the democrats put whoever they wish on the ballot. Just like the judges threw out all existing election laws in 2020.

Do you remember when Democrat Senator Paul Wellstone from Minnesota, died in a plane crash on October 25, 2002 just days before he was expected to be re-elected? The RATS held a highly publicized memorial service that turned into a pep rally. I remember watching it on TV.

Congressional GOP members attending the service had reason to be offended. Jesse Ventura was Governor of the State at the time and originally said he would appoint a Democrat to complete Wellstone's current term to January 3, 2003. He attended the memorial service and walked out saying he was "disgusted" and threatened to appoint an ordinary citizen to serve. In the end, he appointed "state planning commissioner Dean Barkley" to serve the final two months. In the 2002 election, Republican Norm Coleman, Jr. defeated Walter Mondale, who the RATS had dragged in just days before the election took place. When Coleman ran for re-election in 2008, RAT Al Franken beat him by 312 votes. Can you say voter fraud?

RATS are good at changing the rules to suit their needs. Then when the rule they just changed, comes back to bite one of theirs in the ass, they claim the rule is unfair, and want to change it again.
