Concerns about President Biden’s mental sharpness and calls for him to drop out of the race have sparked questions about the 25th Amendment and what role Vice President Kamala Harris would play in triggering that process.
The 25th Amendment allows for the vice president and a majority of the Cabinet to declare a president unfit for office. The vice president then becomes acting president. However, the section of the amendment specifically addressing this procedure has never been invoked.
"The 25th amendment process was designed to be difficult." Jonathan Turley told Fox News Digital. "It is highly doubtful that Harris will play Biden's Brutus."
"For one thing, it is unlikely to garner the needed support in the cabinet. To seek a removal and miss would leave Harris looking not just premature but positively predatorial. With the entire White House staff marshalled to support the President, it would be viewed as a mutinous moment."
Several Republicans have called for the 25th Amendment to be triggered.
"What we are seeing is that they have decided to cover up for Joe Biden to protect their radical agenda as opposed to doing what is in the best interest of the American people," GOP Rep. Byron Donalds recently told Fox News. But at the end of the day, Kamala Harris and the cabinet, they have a responsibility to the American people. They have a constitutional duty to the American people."
Turley said that "given his statements in the last 24 hours" President Biden "would contest the invocation in a disastrous standoff just before the Convention."
"President Biden would quote Grover Cleveland that ‘the ship of Democracy, which has weathered all storms, may sink through the mutiny of those aboard,’" Turley added. "Harris could then find herself overboard rather than the President."

Biden will be the nominee bank it and MSM will follow suit with and the image rebuild will be full on. The debate will be washed away. They are going to pivot to a level of cheating that is beyond anything before.

Warner is trying to knock Biden out, put Harris in his place. His reasoning is that this election cycle is shot. Nobody likes Harris, but rejecting her in a regular primary would alienate blacks, who might not vote GOP, but could stay home. So the best thing is to administer a death blow to Harris’s political career by having her lose in a landslide to Trump, so there’s no possibility of a Harris 2028 run.
Warner’s not doing it for the good of the Democrat party - he’s making a play for 2028. He did do an exploratory review for a White House run in 2008, then discovered he was a nobody with zero name recognition. If he manages to turf Biden, maybe he can sell himself as the savior of the Democrat party in 2028.
Mark Warner making a play for the presidency makes sense. The guy has been senator for 3 terms, and is in his late 60s. It’s 2028 or bust.
If the dems really want Biden out, impeach him. The process is easier; only 50% + 1 in the House. The trial in the Senate requires the same 2/3rds as the 25th. If they can find a crime in a phone call, they can find something for Biden.
While it would be a dramatic and definitive “vote of no confidence” by the VP and members of the Cabinet, it holds no water. Biden would just issue another letter like the one yesterday, but to congress... “Hey, it's all good... I am not incapacitated!” — its then negated.
Impeachment and Conviction is the only way to force it now.
As for the nomination — Biden is right... he has the nomination going into the convention... if some want to change it, challenge it there. Sucks for the Dems, but that's it.
Now, negotiate with Biden to give him a parachute... and that may suddenly change.
Trump, being as smart as he is has no need to announce a VP until Dems get their act together... or the GOP convention.
I agree, and with the amount of cheating that would be required to beat Trump, it’d be difficult for anyone to spin or cover. This could lead us down a very interesting path if the left moves ahead anyway. At that point, the Soap, Jury and Ballot Boxes are all broken.
MSM will not rebuild Biden, a dying man is good for ratings for a weekend, a fighter like trump is ratings gold.
As CNN and Disney illustrate ratings are secondary to forwarding the cause.
