“Another plea for donations will come soon”

Save your money - it’s irrelevant.

It’s of no importance who is “on the ballot” because the voters don’t choose the President, the Electors appointed by the State Legislature do.

There are no “Presidential elections” in the Constitution, no “running”, no “being nominated”, no “being on the ballot”, no “calling a state”, no “conceding” - there is one Presidential election, recently on the second Monday in December, there are 538 voters who meet in 51 separate locations on the same day and choose the President.

The NJ Torricelli/Lautenberg precedent is meaningless because in NJ and in the other 49 states the voters elect the Senator directly, so it requires mischief to count Torricelli votes as votes for Lautenberg.

But for appointing NJ Electors in 2024? That is a reserved plenary power of the State Legislature, NOT the voters, and while in normal times the result of voting in November and the appointment of Electors is aligned, these are not normal times and there is NOTHING in the Constitution that transfers the choice of Electors away from the State Legislature.

Great post. I believe the legal issue related to the 2024 nomination process will come down to individual state laws that govern their primary processes.

That’s true in some states where the election law only posts deadlines for electors to be named, but several states have requirements in their election law that require the candidates for president and vice president also be declared by certain dates or a certain number of days before the election.

There seem to be only a few states with deadlines as early as Ohio, and those also usually make concessions if the convention is late, so I’m not optimistic that these deadlines will help if the Dems get themselves together in time for the convention.

The problem will be if the Dems try to keep Biden through the convention and then plan (or need) to change later. There are a lot of states where it looks like the candidate is locked in by early September. I know at least some states have exceptions for death or 25th amendment, but I’m not sure that all do.

Donations are another thing that goes into the mix, and I don’t know the details of that, but it seems like a lot of donations to Joe stay with Joe or can only be transferred to Kamala. And nobody wants Kamala.

The dems have a lot of finagling to do, and I’m pretty sure there are a lot of factions within the people who have been managing Joe with different plans as to how to proceed. I’m hoping to see an implosion of massive proportions.

This site has a brief overview from every state, but some are incomplete and I don’t think any list policy on exceptions for death/25/etc.
