Heritage Foundation Vows to Make ‘Extraordinarily Difficult’ to Replace Biden on the Ballot

The Heritage Foundation vowed Wednesday to make it “extraordinarily difficult” for Democrats to replace President Joe Biden on the ballot.

“If the Biden family decides that President Biden will not run for re-election, the mechanisms for replacing him on ballots vary by state. There is the potential for pre-election litigation in some states that would make the process difficult and perhaps unsuccessful,” Heritage Oversight Project stated in a memo that was compiled in April and released last week ahead of President Joe Biden’s “disastrous” debate performance.

Heritage Oversight Project Executive Director Mike Howell, who authored the memo, said that replacing Biden would be “extraordinarily difficult” and that they would ensure it would make it “extraordinarily difficult” to replace the 46th president on the 2024 ticket.

That’s true in some states where the election law only posts deadlines for electors to be named, but several states have requirements in their election law that require the candidates for president and vice president also be declared by certain dates or a certain number of days before the election.

There seem to be only a few states with deadlines as early as Ohio, and those also usually make concessions if the convention is late, so I’m not optimistic that these deadlines will help if the Dems get themselves together in time for the convention.

The problem will be if the Dems try to keep Biden through the convention and then plan (or need) to change later. There are a lot of states where it looks like the candidate is locked in by early September. I know at least some states have exceptions for death or 25th amendment, but I’m not sure that all do.

Donations are another thing that goes into the mix, and I don’t know the details of that, but it seems like a lot of donations to Joe stay with Joe or can only be transferred to Kamala. And nobody wants Kamala.

The dems have a lot of finagling to do, and I’m pretty sure there are a lot of factions within the people who have been managing Joe with different plans as to how to proceed. I’m hoping to see an implosion of massive proportions.

This site has a brief overview from every state, but some are incomplete and I don’t think any list policy on exceptions for death/25/etc.

Heritage probably won’t fight a 25th move. The only politician less popular than Joe is Kamala. The fight to replace here will burn down the rat party.

I might even identify as a dem to denounce giving Kamala the Aunt Jemima/ Uncle Ben treatment to erase her. Operation Chaos 2.0

Ballot prep deadlines. Some are past and many looming.

I provided specific information: Ohio is the first deadline for ballot access, August 7th. If you believe "some are past" please give the State and the date. And then for extra credit you might explain who put Biden on the ballot when he is not yet the nominee.

I thought Bill Clinton was likely to meet an untimely demise in 2016, so that Mrs. Clinton would get the sympathy vote. Perhaps he was lucky that she was confident of victory.

Wouldn’t surprise me if Biden has a health issue, fatal or incapacitating, that knocks him out of the race. Maybe they’ll try to pin an assassination on Trump/MAGA.

Or just assassinate Trump.

Given his age and infirmed condition, if he isn't being shielded from what is going on, I don't see how a person could hold up much longer.

I think I read if he steps down he has no protections; he has be removed by section 4 of the 25th amendment.

Because the primaries already happened AND, more importantly, the filing deadlines have passed in every state.

It’s a real possibility that one or more swing states will not allow a Democrat nominee other than Biden to be on the ballot. Trump already has an advantage to win, this would add to that advantage.

Changing nominees at this point is the Democrats saying “do-over” but not really doing a do-over because they can’t redo the primaries and give people a chance to vote again on their preferred candidate.

All 50 states have laws for how political parties can select a candidate and get his or her name on the official ballot of the federal election for president. They can’t simply demand that these laws be ignored because they are inconvenient.

You cannot “replace” what does not exist.

Neither the Democratic or Republican parties have nominated a candidate for President.

That is done in the upcoming national conventions.

This article is total rubbish.

No state will deny a Democratic nominee a position on the ballot if they are chosen by their upcoming convention.

It just will not happen in the real world.

There is no Democratic nominee right now. There is nobody to “replace”.

It’s not automatic. There are filing deadlines. There are ballot deadlines.

The DNC has been filing multiple lawsuits to stop one of their own party members, RFK, from being able to be on the ballot in many states. Some of their arguments for preventing his ballot access will apply to them.

It is possible that they switch their nominee and get the new one on the ballots in all 50 states, but it will be an uphill battle and is not as certain or simple as you imagine.

You have to remember that this is one of many difficult calculations they must make in deciding to switch candidates so late. Even if Biden is replaced, where does the new candidate get campaign money? How will the switch be perceived by the public? How can they do this without evoking a civil war within their party? How can they justify calling for his replacement as a candidate but not his replacement as the current president? How will they make everyone happy who feels they did not have a say at all in the selection of the nominee? What if merely 5% sit this election out in protest?

There are certain issues here are legit and some that are not.

Campaign finance—not legit. The current bank balance of the Biden campaign is less than 10% of what is needed for a national presidential campaign. At worst a new nominee suffers a 10% penalty—no biggie.

Filing deadlines—don’t buy it for a minute. The convention dates have been known for a year. The courts of the states will require the nominee of the convention to be allowed on the ballot. It may require some litigation—but imho the end result is not in doubt.

The legitimate issues are more political in nature—separate and much trickier topic.
