Here's why it would be tough for Democrats to replace Joe Biden on the presidential ticket

President Joe Biden's halting debate performance has led some in his own party to begin questioning whether he should be replaced on the ballot before November.

There is no evidence Biden is willing to end his campaign. And it would be nearly impossible for Democrats to replace him unless he chooses to step aside.

Here's why:

Delegates Biden won in the primaries are obligated to support him

Other potential Democratic candidates would also face challenges

In addition to the vice president, others that had endorsed Biden in 2024 while harboring their own presidential aspirations for future cycles include California Gov. Gavin Newsom, Michigan Gov. Gretchen Whitmer, Pennsylvania Gov. Josh Shapiro, Illinois Gov. J. B. Pritzker and California Rep. Ro Khanna.

Still others who Biden bested during the party’s 2020 presidential primary could also try again, including Sens. Bernie Sanders of Vermont, Elizabeth Warren of Massachusetts and Amy Klobuchar of Minnesota, as well as Transportation Secretary Pete Buttigieg.

If Biden were to abruptly leave the race, conservative groups have suggested they will file lawsuits around the country, potentially questioning the legality of the Democratic candidate's name on the ballot.

But Elaine Kamarck, a senior fellow in governance studies at the Brookings Institution in Washington, who wrote a book about the presidential nominating process and is also a member of the Democratic National Committee’s rulemaking arm, said that courts have consistently stayed out of political primaries as long as parties running them weren’t doing anything that would contradict other constitutional rights, such as voter suppression based on race.

“This is very clear constitutionally that this is in the party’s purview,” Kamarck said in an interview before the debate. “The business of nominating someone to represent a political party is the business of the political party.”

Yep, unless Biden goes along with it, Obama and crew can whine and moan all they want but they can’t deny him the nomination as he already has enough delegates. The delegates HAVE to vote for Biden as the nominee. The only way he could be replaced at this point is after being nominated, he formally declines the nomination at which point all his delegates would be freed and we would have an open convention where anybody’s name could be put into contention.

Biden is very obstinate and bitter and egotistical, among other things. Jill keeps him under her thumb and it will not be easy for them to get him to step aside.

Oh she’s always been a possibility even since she made her bones as one of their stars during Covid, and then played victim in a terrorist kidnapping plot they themselves set up. All that would come back to bite her though, and the media would not be on her side, or at least would not make it easy for her.

Sooo… apparently the 25th Amendment is not a consideration and does not come into play? Last night’s debate should end any doubt Biden is incapable of performing tasks other than warming a chair.

Joe has committed a lot of crimes that the Democrats can hold over his head to get him to quit.

They can say, “I would hate that a criminal investigation into your business affairs has to be started.”

there have been contested conventions in the past

the nominee was not known until the convention

Interesting post there. As others have noted, Biden has way more than enough delegates to win on the first ballot.

But wait. Perhaps the DNC could meet next month and change the rules: Delegates no longer have to vote for their pledged candidates on the first ballot. They are free agents from the start.

That might work…if Biden’s pledged delegates are more loyal to the party than to him personally.

There is a lot more involved than just slapping someone you like in the slot.

"In order to get on the ballot, a candidate for president of the United States must meet a variety of state-specific filing requirements and deadlines. These regulations, known as ballot access laws, determine whether a candidate or party will appear on an election ballot. These laws are set at the state level. A presidential candidate must prepare to meet ballot access requirements in advance of primaries, caucuses, and the general election."

I believe this ship may have already sailed.

My guess is that more than one SS agent on the Presidential detail is also an undercover a CIA operative. Just saying...

The delegates that came out of the primaries have to vote for Biden, but I heard someone the other day mention that because the Democrats have so many super-delegates (something the Republicans don’t do), they can out vote the regular delegates if they vote as a block. Would be interesting to see.

If Obama meets with Joe, Jill and Joe’s Cabinet and sets a deadline for Joe to step down (or at least announce a la LBJ that he is not running for reelection) and that if Joe fails to comply, Obama will publicly announce that in his opinion Biden is mentally incompetent and call for the Cabinet to remove him via the 25th Amendment, then I think Biden / Jill would have very little choice but to comply.

In addition, the Democrats have all those fraudulent absentee and mail-in ballots filled out and ready to go. If Biden is not the nominee, the Democrats will have to throw those out and start all over.
